The bachelor´s thesis focuses on the evaluation of the debts of chosen business entity from 2015 to 2019. The theoretical part of the thesis is focused on important juridical terms and debts from an economic point of view. The analytical part of the thesis deals with the development of debts of specific entity and methods of securing and collecting debts which this entity uses. Based on the analytical part of the thesis, suggestions are made for the improvement of the current situation of securing and collecting debts.

This bachelor thesis deals with securement and enforcement of debts especially in the case of debtor’s insolvency. Theoretical part describes fundamental concepts from legal, accounting, tax, and economic point of view. Analytical part deals with satisfaction, assignment, and securement of claims of three creditors during the insolvency proceedings. This is followed by outlined measures for creditors regarding failed repayment of claims and to obtain the highest possible satisfaction in case of debtor’s insolvency.

Loan Agreement, focusing on Position of a Bank as Creditor

This viva focuses on the issue of loan agreements, from the viewpoint of the bank as the loan creditor. The introductory chapters are devoted to specifying the loan concept and its role in economics, and also the legal definition of a loan agreement and its historic development. The following chapters define the terms for valid origin of a loan agreement and define its contracting parties. Emphasis is placed on specification of the position of the bank as the creditor. The next part of this paper acquaints the reader with individual issues of existing loan agreements. This particularly concerns the topic of drawing and repaying the loan, currencies, the value and interest on the loan and the topic of security, general business terms and conditions and finally also the issue of immediate maturity of a loan. This is followed by chapters devoted to execution of rights arising from the loan, with the understanding that emphasis is placed on the methods representing a more effective alternative to the standard finding procedure. Direct sale, notarial records with an immediate enforcement clause and the institute of assignment of receivables are also discussed. Phenomenon of Debt Relief in Context of Changes from 1 July 2017

This bachelor thesis describes the changes related to the debt relief, that presents the amendment of Insolvency Act No. 64/2017 Coll., which is effective from 1 July 2017, amending Act No. 182/2006 Coll., Bankruptcy and the Methods of its Resolution. This is an important amendment, which transforms a lot of fundamental paragraphs of the Insolvency Act. The thesis provides the essential introduction to the topic of the insolvency proceedings and the debt relief analyzing the current legal regulation of this institute. The changes of Insolvency Act are described and evaluated using analytical method in the context of past and future development. In the practical part is proposed model of debt relief process using process maps.

Next part presents own sollutions to improve more effective debt collecting and debt securing. The own sollutions are evaluated from the point of view of economic demands and feasibility in practice.
