Legal regime of protected areas and protective zones by the water protection

84 ABSTRACT This thesis is concerned on the topic "Legal regime of protected areas and protective zones by the water protection." Water like environmental compartment has a key role to the existence of life on Earth. That is the reason for its protection. For achieving this protection could not be protected only this environmental compartment, but it is necessary to focus on other ones, which are related to this protection. The main aim of this thesis is to analyse the situation and the ways of ensuring the territorial water protection, to point out the basic types of them and their similar and different characteristics and provide a comprehensive explication of territorial water protection. For these reasons, the thesis is divided into two parts. The first is dealing with systematization of water protection and water protection relationship as a whole and territorial water protection as one of its important elements. This part is necessary for the orientation and the issue of inclusion territorial water protection to the entire system of water protection. Legal regime of protected areas and protective zones to protect water

This diploma thesis deals with the legal regime of protected areas and protective zones used to protect water. The diploma thesis is composed of four chapters. Chapter one defines basic terms, a protected area and protective zone, in general. This chapter also contains a comparison of both institutes and their application in environmental protection. The second chapter deals with the sources of relevant legislation protected areas and protective zones to protect water. Chapters three and four are central of the thesis as they contain an interpretation of legislation of each types of protected areas and protective zones to protect water. For individual institutes is analyzed their concept, function, form and method of their determination and especially their special legal regime based namely on bans and restrictions regarding certain activities in the given area. Attention is also paid to various limitations of property rights to real estate in the protected areas and protective zones and to possible compensations for such limitations.
Legal regulation of the territorial protection of nature

This thesis deals with the historical development and the positive law of the territorial protection of nature. A lot of treaties and other documents were made on the international and the European level. The legislation of the European Union is also very important in Europe, especially two directives, that gives a basis to the creation of the Natura 2000 network. The Czech Act on the Protection of Nature and the Landscape regulates the general territorial protection of nature, the system of six catagories of the special territorial protection of nature and other related institutions of law.
Legal regulation of National Parcs in the Czech republic and Poland

The purpose of my thesis is to analyze the legal regulation systems in the Czech Republic and Poland, compare them, show the attitudes of the two countries on this issue and propose potential changes in Czech legislation. The comparative method of research was chosen because of its suitability for the geographical, historical and social proximity between the Czech Republic and Poland. The thesis is composed of five chapters. Chapter One illustrates the historical development of legal regulation and is divided into three subchapters, the first dealing with Czech history, the second with Polish history and the last with the history of the Krkonoše/Karkonosze National Park, now a transboundary park (from the very beginning, the Czech and the Polish parts cooperated with each other). The second chapter consists of four parts and concerns international law. Subchapter One is about historical development, Subchapter Two focuses on IUCN, Subchapter Three contains two parts - examples of international and regional treaties. Resumé Právní úprava ochrany dřevin Tato práce se zabývá problematikou právní ochrany dřevin rostoucích mimo les. Okrajově je předmětem této práce i problematika právní ochrany lesa. Autor se ve své práci zaměřuje na praktické otázky zkoumané materie, s ohledem na své praktické zkušenosti a navrhuje některá dílčí řešení. Prioritním cílem autora není vyhledání všech problémových ustanovení, která se dotýkají zkoumané materie, ale posoudit úroveň právní úpravy v globálním měřítku. Blíže se zabývá těmi nedostatky, které považuje za závažné z pohledu předmětu ochrany a pokouší se o odstranění těchto nedostatků vlastními návrhy, případně zahraniční, konkrétně slovenskou legislativou, která z globálního pohledu upravuje zkoumanou problematiku v některých případech efektivněji a může tak sloužit jako inspirativní vzor pro Českou republiku. Zusammenfassung Die Rechtsregelung des Schutzes der Nationalparke in der Tschechischen Republik und Deutschland Der Gebietsschutz wird zu den wichtigsten Instrumenten des Naturschutzes gezählt. Die Schutzgebietskategorie "Nationalpark" (NP) ist ein etabliertes Instrument. Trotzdem wird die Diskussion über Nationalparke sehr angeregt geführt. Vor dem Hintergrund der Vorbereitungen eines neuen Gesetzes für den bestehenden Nationalpark Šumava (der größte tschechische Nationalpark) ist dieses Thema in der Tschechischen Republik sehr aktuell. Die vorliegende Arbeit vergleicht die Rechtsregelungen für Nationalparke in Tschechien und Deutschland. Ihr Ziel ist es, hiervon Rückschlüsse für mögliche Änderungen de lege ferenda zu gewinnen. Large-area Protected Areas of Nature in Western Bohemia and Eastern Bavaria from Legal Perspective

The topic of this thesis is Large-area protected areas of nature in western Bohemia and eastern Bavaria. Within this topic, the thesis focuses mainly on less strict categories of these areas, i.e. on Czech landscape protected areas ("chráněná krajinná oblast") and Bavarian nature parks ("Naturpark"). From each of these two categories, I chose one particular representative area to deal more in detail with. These representative areas are Český les Landscape Protected Area and the neighbouring Bavarian Nördlicher Oberpfälzer Wald (Northern Upper Palatinate Forest) Nature Park. The aim of this thesis is to describe, analyse and compare the aforementioned protected areas, and - as the result - to evaluate the level of protection of these on both sides of the Czech-Bavarian border, as well as to potentially find inspirations for improving the relevant Czech legislation. Interactive natural trail in the Milíčovský forest and ponds natural monument

This master thesis is the groundwork for realization of an educational nature trail in the Natural monument Milíčovský Forest and Ponds. The theoretical part deals with the nature protection in the Czech Republic, as a part of the European Union. Moreover, the characteristics of the given area are elaborated in detail with a focus on geology, flora and fauna in this part. In the practical part, I utilised the basic information as a basis for individual panels of the educational nature trail,. The graphical layout of individual panels is attached as an apendix of the thesis. The purpose of this study is to contribute to the protection of natureal values in Natural Natural monument Milíčovský Forest and Ponds. The information provided in this study should have wider impact in the way that they improve general understanding of nature. Furthermore they should extend general knowledge about Milíčovský Forest of its visitors and simultaneously they should reinforce their positive attitude toward nature as a whole.
Agriculture in the Protected Landscape Area Šumava

Landuse for farming purposes is an indispensable part of management in specially protected areas although the process of farming has been importantly limited by restrictive arrangements, as agrotechnological terms which are caused by the needs of environmental protection. This diploma thesis deals with the impact of some limiting rules on running of the farms which are farming in convenction way, situated in the area CHKO Šumava. Field research was performed in the form of dialogs and was focused on detection of owner´s opinions concerning their relationship with CHKO authority, impact of agrotechnological terms on running of the farm and revealing of their future plans. Based on the analysis it is possible to say that all the farmers declare the cooperation with CHKO authority as definitely negative whereas the present payments for natural disadvantage compensation appears to be clearly positive and they cannot imagine future farming without them. Agrotechnological terms followed from specific regime of specially protected areas have been declared as minimally restrictive because the owners have adopted them the farm working.
