The Person of Arbitration in International Commercial Arbitration

The topic of the thesis is The Person of Arbitrator in International Commercial Arbitration. Arbitration has undergone a number of changes in recent years. This procedure is very popular not only for a choice of Arbitrator, but also for its speed and lower costs, as compared to the other methods of dispute resolution. In the work has been carefully analyzed the whole procedure from the viewpoint of an Arbitrator, especially his duties and powers. The amendment to Act No. 216/1994 Coll. - Act No. 19/2012 Coll., with effect from 1.4.2012 was to distinguish arbitration for consumer and without consumer. Part of the thesis are also proposals de lege ferenda.
Corporate social responsibility and its influence on society

Bachelor thesis "Corporate social responsibility and its influence on society" deals with a form of responsibility in corporate behavior and its effect on surrounding world. A lot of new threats have come up these days because of still rising economic growth. That's why the traditional form of responsibility has to be changed. Corporations have started to implement concept of corporate social responsibility to their business strategies focused on wide spectrum of stakeholders. Thesis is based on qualitative research and presents corporate social responsibility itself and its role and position in society from different views of four groups of stakeholders. I chose these groups: corporations with strategic social responsibility, employees from corporations with and without the concept, nonprofit organizations and customers. Thesis deals with experience of the groups with corporate social responsibility, its influence on them and whether the concept is seen more like marketing strategy and PR or nonprofit helping and being responsible. Survey finally discovered educative influence of corporate social responsibility on society and that the groups are developed by the concept. The relationship between liability for damage and liability for defects

Résumé My diploma is focused on mutual relationship between the title from liability for damage and the title from liability for defect. Firstly, I tried to explain every institute separately and in the end of my work I dealt with their interrelation. In the first Chapter I outline a picture of civil liability in the level of juristic theory and I bring a view on the origin and content of civil liability. In this Chapter I point out that the understanding of the term of civil liability is non-uniform, which leads to serious opinion fragmentation. One of the main tasks of the legal order is to ensure the protection of the society and individual from the conception of damage with the aid of legal rules together with coercive state authority. It means that the protection of their health, property, as well as nature and the environment should be provided. Legal order realizes this task through the prevention of damage conception, what was the object of the second Chapter. I place emphasis on general and special prevention and I clarify in what they vest. Three critical voices of post-war American literature

The thesis deals with critical views of the post-war American society as found in three literary works: Arthur Miller's Death of a Salesman, J.D. Salinger's The Catcher in the Rye and Jack Kerouac's On the Road. The thesis's aim is to introduce briefly the post-war society and then, on basis of text analysis, to provide criticism expressed by each book mentioned above. Divided into four main parts, it describes the post-war situation in the United States (political, social and cultural) and thereafter it focuses on the books itself. It provides a short biographical summary of each author's life but it mainly targets the criticism the book contains. The post-war period was significant because of the change it brought. The society of the 1950s was characterized by many "booms" that contributed to its development. The main features of this period were consumerism and materialism; these were also the principal things subjected to criticism. The question the thesis wants to answer is whether this criticism was justified or not. This objective is realized in the conclusion. Damages in medical malpractice

The purpose of my thesis is to analyse legal regulations of damages in cases of medical malpractice. The reason for my research is the increasing number of the above - mentioned cases in Czech Republic as well as the fact, that the contemporary legal regulations seem to be unsatisfactory, in particular with regard to damages for pain and suffering. The thesis is composed of seven chapters, each of them dealing with different aspects of damages in medical cases. Chapter One and Chapter Two are introductory and define basic terminology used in the thesis: Medical facility, medical staff, informed consent and lege artis performance. Chapter Three examines liabilty according to the Czech Civile Code in the general way, regarding to it's functions. Chapter Four is focused on the liability in cases of medical care and attempts to zoom in the characteristic features of such cases. The chapter is subdivided into four parts and provides an outline of relevant Czech regulations of liability. Whereas part one is intoductory, part two targets an obligation to prevent damage. Carrier's Liability in International Carriage of Goods

The purpose of this thesis was to analyse and compare isseu of carrier's liability in international carriage of goods. Thesis is devided in seven parts, which offers outline of carrier's liability in particular modes of carriage. First part deals with term contract for the carriage according civil code, parts of this contract as well as another contracts which aim is carriage. Furthermore deals with term liability and put outline of distinction among strict liability and liability for fault. Last subchapter of first part describes term carriage. Second part describes legal framework of contract for the international carriage of goods and specifies distinction among choice of law and direct method. Remaining parts refer to carrier's liability according international treaties concerned with particular modes of carriage, i. e. international carriage of goods by road, by rail, by air, by sea and by inland waterways. Bigger attention is dedicated to third part which deals with carrier's liability in international carriage of goods by road. The proposal of the competency management model in the business entity

The thesis is focused on the personnel competencies and responsibilities issue of individual managers at various management levels in the manufacturing department of Robert Bosch Inc. in České Budějovice With the increasing number of manpower in the company an organization structure enlarges, which is followed by the growth of decision-making power and responsibilities. The human resources department as well as managers have to deal with delegation and distribution of each competence. The aim of the thesis is to propose the management of personal competence model of in a chosen entrepreneurial subject. The theoretical part is providing essential knowledge background, while the analytical chapter contains the characteristics of the selected business entity. And it is composed of a personal interview research. Each answer is processed in dedicated competency matrix with regarding evaluation. After that is suggested a model with optimal distribution of personal competences and recommendations within particular managers.
Social responsibility and the application of ethical principles in public administration

Code of Ethics in Public Administration, which takes into account the daily exercise of fundamental ethical principles in public administration, should be moral regulation governing professional personal approach to public administration addressees. It can not be at the level of sanctions enforceable regulation, which applies to public administrators. Rather, it should be the norm every institution containing socially acceptable ethical principles reflecting the basic principles of good governance that would permanently stabilize desirable responsible professional approach executors of public administration within the defined legislation. Thus, the aim of the code of ethics, which should be in every institution open to the public in paper or electronic form, should be sustained to ensure the basic requirements among the participants of the public administration. Basic principles of ethical principles, supplemented by observations of the authors cited in the thesis could help a number of public institutions in developing their own code of ethics and social responsibility for formulating its practical observance.
