Security of persons with long-term unfavourable health condition

The aim of this thesis is to summarize all the possible obligations from the social security system for which a person with a long-term unfavourable heath condition is entitled, simultaneously taking the perspective of palliative care into focus. In the introductory chapters this issue is set into the domestic and international legislative frame. Obligations within particular subsystems of social security are described in chapter four, five and six. The last chapter is focused on palliative care. In the first chapter the term social security is investigated and basic terminology taken from Czech legislation related to this topic is defined. The second chapter offers an overview of the historical development of social care and of rights of persons with disabilities. In the third chapter influence of significant international organizations on the issue of social security is reviewed. Chapter four deals with the system of sickness insurance. In its six subchapters the thesis provides a general characterization of sickness insurance, sickness insurance participation, sickness benefits entitlement, reimbursement, support period, the amount of sickness benefits and work capacity assessment. Pension reform in the Czech Republic

The thesis deals with pension reform in the Czech republic. The main objective of the thesis is to analyze czech pension system and reforms. The thesis is divided into an introduction, a conclusion and four chapters. The first chapter is concerned with social security system and its subsystems, the second one with the pension system, its history and reforms. The third chaper deals with the upcoming changes and the fourth one presents author's suggestions on possible changes to the system. Realization of a pension reform is a long and extremely dificult process. It has be implemented very carefully with an emphasis on preserving the principle of social justice and the principle of human dignity.

Social security of women during pregnancy and maternity The purpose of thesis is to analyse social security of women during pregnancy and maternity in the current legislation in Czech and Slovak republic. The thesis is composed of four parts. Parts are divided into chapters. First part includes introduction, historical development of social security of women during pregnancy and maternity in the Czech and Slovak republic and chapters, which focuse on social security of pregnat women and parents of small children in connection with membership of the Czech and Slovak republic in international organisations and the European union. Second part analyzes system of sickness insurance, system of state social support, benefits, that are provided to women in case of pregnancy and maternity, and labour law protection in the Czech republic. Third part describes social security of woman during pregnancy and maternity in Slovak legislation, and labour law protection of pregnat women and parents of small children. Part four summs up and compares system of protection and social security in the Czech and Slovak republic. The thesis concludes with the general summary. The Position of Pregnant Employees and Female and Male Employees Looking After a Small Child in Labour Law and in Social Security Law

The purpose of this thesis is to judge the current legal regulations regarding the position of pregnant employees and female and male employees looking after a small child in labor law and in social security law. In labor law these are namely prohibited types of work, re-assignment to another kind of work, business trips and relocation to another place of work, breastfeeding breaks, protection of employees against the notice of termination of employment and legal regulations on maternity and parental leave. In social security law these are namely benefits determined for pregnant employees or female and male employees looking after a small child such as maternity benefit, benefit paid to pregnant employees or to employees looking after a small child to counterbalance loss of earnings after the re- assignment to another kind of work due to their pregnancy or parentage, sickness benefit, nursing benefit, birth allowance, parental allowance and further the issue of different determination of the pension age for women and men. The main aim of this work is to describe and systemize information concerning the old-age pension system and its reform in the Czech republic de lege lata. This work describes the pension system in the Czech republic, which consists of three "pillars"; "first pillar" - the traditional social security system, "second pillar" - the opt-out modification of the traditional social security system, and "third pillar" -. the supplementary pension system. Health insurance companies in the system of health insurance

This thesis analyses the health insurance companies in the public health insurance. First chapters consist the theoretical background of health insurance and subsequently the historical development of health insurance in the Czech Republic (Czechoslovakia). The focus of this thesis is laid on the development of health insurance in the last two decades. The work compares the legislation of the General Health Insurance Company of the Czech Republic and the so- called employment insurance companies. Attention is paid to the legislation of the organizational structure of health insurance companies and their economy, particularly the regulation of their funds. Some of the economic indicators of the General Health Insurance Company of the Czech Republic and the Health Insurance Company of the Ministry of Home Affairs for the years 2010 - 2012 are listed for a comparison.

130 Abstrakt v anglickém jazyce We comprehend the coordination of social security systems as an interconnection of social security systems of Member States therefore the free movement of persons can be carried out. The aim of Coordinating Regulations is to ensure that a migrant does not loose his/her claims on social rights due to his/her enjoyment of free movement. Concerning the large extent of this topic the thesis is focusing only on old-age and survivors' pensions according to valid Regulations (EC) No 883/2004 and No 987/2009 of the European Parliament and of the Council which entered into force on 1 May 2010. The preliminary chapter out of five at total generally presents the nature of the Coordinating Regulations. It clears up their development and aims. It further introduces other sources of coordination law and explains their relations with other sources of EU law and international law. The determination of personal and material scope of Coordinating Regulations is the indispensable part of this chapter as well. Deciding of the Czech Social Security Administration upon benefits from pension insurance

This thesis deals with the application of the law on pension insurance. Thus its subject is not only the legislation itself, but this thesis is much rather devoted to the interpretation of law on pension insurance and to the limits given by the nature of the legislation, to the application practices and to the analysis of decision-making mechanism. Within the framework of this thesis the emphasis is put on the question of evidence. In this context, the work underlines the time frame of facts required to be proven and the requirement for aplication of already void legislation. Special attention is paid to the use of a special decision-making procedure which allows to forgive requiremets for meeting legal conditions in particular cases. In this thesis I formulate arguments in favor of using the methodological pluralism rather than strict clinging to a grammatical method of interpretation, arguments for prefering principle of procedural efficiency to investigative principle in some justifiable cases and for precisely expressed binding legal opinions made by courts as outcomes of judicial review. Welfare of women during pregnancy and maternity

In this thesis I processed the options of support for women during pregnancy and maternity which could be offered by the legislation of the Czech Republic and also the possibilities which were connected with their accession to the European Union. I also mentioned planned law changes which the new government of the Czech Republic wants to get through in their election period of 2013-2017. The thesis is divided into two parts. The first part, "The Social Security of Women During Pregnancy and Maternity According to Czech Legislation" consists of four chapters: 'The Evolution of Social Security', 'The Social Security and Its Systems', 'The Social Security Within the Sickness Insurance' and 'The Social Security of Women Within the National Social Support'. In these individual chapters there are processed historical context of social security law evolution and then individual institutes serving for securing woman during pregnancy and maternity. The institutes consist of benefits in maternity and equalized contribution within the sickness insurance and also of child benefit, maternity grant and parental allowance within the national social support.
