The Preparatory Procedings De Lege Lata, De Lege Ferenda

This thesis aims on the basis of an assessment of the current state of the preparatory proceedings including its relationship with the judicial proceedings, and thus the concept of the criminal proceedings, reach within the considerations de lege ferenda the ideal definition and adjustment of the preparatory proceedings, including the determination of its position in criminal proceedings, and thus the establishment of a new concept for criminal procedural law. All this work reacts to the current state of the Czech criminal proceedings, which can be considered at least as stagnant and it would be right to uncover the causes and consequences of the current situation so that they can be avoided in the future.
