V ČESKÉM JAZYCE VÝJIMKY A OMEZENÍ AUTORSKÉHO PRÁVA Z POHLEDU EVROPSKÉHO A ČÍNSKÉHO PRÁVA "Výjimky a omezení autorského práva jsou nejdůležitějším právním nástrojem pro sladění autorského práva s individuálními a skupinovými zájmy široké veřejnosti,"1 konstatuje Deklarace o vyvážené aplikaci třístupňového testu. Autorské právo dnes hledá své hranice jak co do vyvážení práv autorů, držitelů autorského práva (pokud jsou od autorů odlišní) a veřejnosti či uživatelů, tak v kontextu nových technologií a nových, rozvíjejících se způsobů užití autorských děl, v nichž se často spotřeba a tvorba prolínají. Mimoto se zintenzivňuje proces nalézání hranic toho, co bychom mohli nazvat obecně uznávaným standardem autorského práva na podkladě mezinárodních smluv, a prostoru, který je výsostnou doménou jednotlivých států a je pro regulaci ponechán právě jen jim. Výjimky a omezení autorského práva jsou "bitevním polem", kde se tato rovnováha nalézá nejčastěji. Je proto zajímavé uskutečnit komparaci českého přístupu k otázce výjimek a omezení, determinovaného jak koncepty a teoriemi ryze českými, tak příslušností českého práva k (dnes již) nadřazenému právnímu řádu Evropské unie, s právním řádem "orientálního giganta", Čínské lidové republiky. RESUMÉ Unauthorized use of author's work This diploma paper deals with the unmaintainable situation in which copyright law (author's law) appeared. In the preface the importance of copyright for industry is highlighted. The new digital age in which we live nowadays provides for copying the work in a good quality. Then this paper describes some chosen issues and talks about the alternatives to copyright law. Firstly, a basic legal institution of Czech copyright law are described, such as what is copyright law, what is a work, who is an author, which rights does he have, exceptions to these rights, author's remuneration etc. After that follow legal sources on the international, European and national level (especially TRIPS, WIPO Treaties, EU Directives concerning copyright and Czech Author's Act No 121/2000 Coll.). Secondly I chose three areas of up-to-date problems that are: the digitalization of works by libraries, peer to peer sharing of works via Internet and the protection of computer programmes. Radomír Pivoda Srovnání autorskoprávní ochrany autora a výkonného umělce A comparison of copyright protection of authors and performing artists The main goal of this thesis is to compare the key aspects of the copyright protection of authors and performing artists in the Czech Republic. The basic differences are explained with respect to its historical evolution, which is put into context with the current social situation in the field of art. The paper is divided into six chapters. The first chapter gives an explanation of the basic terminology used in the area of copyright law and sets the frame for the comparison of authors and authorship and performing artists and their artistic performances. In the Czech Republic, authorship is based on the expression of a piece of art in any way perceivable by human senses. There is no registration principle in effect. This fact provides the starting point for the protection of authors' rights. Therefore it is important to precisely define what can be considered a piece of art and who can be recognised as an author or a performing artist. "Copyright and China: Protection Against the Violation of Authors' Rights in the People's Republic of China" SUMMARY - ENGLISH "On September 7, 1990, at the Fifteenth Plenum of the Standing Committee of the Seventh National People's Congress (NPC), the People's Republic of China promulgated the first copyright law in its history, with 102 votes in favor and ten opposed or abstaining. The establishment of the Copyright Law marked the end of a tortuous road that had snaked through the Mao era and spanned the entire first half of the reform era as well."1 And let us add that the following course taken towrds the establishment of a Chinese copyright law system was not quite less dramatic, and neither is the situation of the Chinese copyright law at present. This thesis by no means aspires to cover, to contrast and compare in an exhaustive manner, the whole of both the Czech and Chinese copyright law systems (or, since both the countries draw their theoretical grounds more or less from the continental copyright doctrine, "right of autorship" systems) currently in force. Unlawful Use of Copyrighted Work (and the Author's Fee) This graduation thesis is devoted to the issue of unlawful use of copyrighted work and to the author's fee. Currently the issue of unlawful use of copyrighted work as well as legal protection of that work is becoming much more interesting than approximately twenty / thirty years ago. This situation is caused by three main circumstances - the growth of piracy (copyrighted works like books, films, sound recordings, computer programmes and so on are widely used now, and in some states it is even very important business), the advent of satellite communication (increasingly entertainment and information services are more available) and the advent of the Internet (because of the worldwide linking of the millions of computers it is very easy to access to, copy and distribute copyrighted works). The aim of the manuscript is to explain this topic and to provide a review of collective management and its modification in accordance to European law.
