The Czech legal system in the time of the coronavirus in the light of Fuller's principles of good law Trust in law-making institutions Abstract This thesis deals with the issue of how the Czech legal system changed during the coronavirus crisis in the light of Fuller's principles of good law. The aim of the thesis was to find out how this change affected people's trust in law-making institutions. The thesis is divided into four parts. The first part introduces Lon L. Fuller as a philosopher of law, who significantly influenced the view of legal theory and provoked many responses to his views from both his critics and supporters. The second part of the thesis is a theoretical background to the specific features of the legal system in the situation that arose due to the spread of the Covid-19 disease in the Czech Republic. In the next part of the thesis I subject the legislation issued during the coronavirus crisis to Fuller's requirements of what law should look like. By analyzing the case law of administrative courts, especially the reasoning for their judgments, I found cases of violations of Fuller's principles that occurred during the coronavirus period. 1 Populism as a threat to liberal democracy and the role of media Abstract This master's thesis focuses on concept of populism as an ideology. The first part of this thesis is concerned with the analysis of a hypothesis that views populism as a threat to liberal democracy and this hypothesis is then proven on various individual aspects of liberal democracy as is defined by Andrew Heywood. Next, this thesis is concerned with some critics of the concept of the liberal democracy itself such as Carl Schmitt or Chantal Mouffe. As shown on the example of an article by Belgian political scientist Chantal Mouffe it refutes the concept of left-wing populism as a ,,good" populism. Then, it concerns with some of the critical remarks of Ivan Krastev and Stephen Holmes that were outlined in their book The Light that Failed: A Reckoning. The next subchapter is concerned with some explanations as to why people are voting for populists - this includes the crisis of representation, then language used by populists and finally the desire to be recognized. Synthesis of chiral secondary amines useful as organocatalysts

This bachelor thesis deals with the preparation of chiral secondary amines, which are used as catalysts in many chemical transformations leading to enantimerically pure compounds. The emphasis of this work is placed on the comparison of the effectiveness of published syntheses those organocatalysts. The first part focuses on the comparison of efficiency and optimization of two methods of preparation Jørgensen's catalyst, the first approach is based on the Z-protected (S)-proline, and in the second approach as starting material was used. The second part deals with the preparation of other Jørgensen's and Hayashi's types of catalysts, via introduction of various silyl functional groups.
Reforming Legal education in the Czech Republic

Reforming legal education in the Czech Republic Abstract Under the influence of globalisation, European integration and digitalisation, knowledge and skills required for performance of legal professions change dramatically. In order to remain relevant Czech law schools have to adapt to this new environment. Presented thesis is comparing legal studies at the Charles University Faculty of Law (CUFL) and University of Utrecht. The aim is to identify state-of-the-art features of the Dutch educational model which could be implemented at CUFL. Comparison concerns main components of educational process (admission, teaching, examination) but also structure of the programs and curriculum. Findings are presented in wider societal context. Although there are notable differences at the level of educational system (admission, university governance) or national educational policy (funding), a number of findings could be applied in the Czech Republic. Compared to the Dutch study program, CUFL is lacking deeper connection between individual educational elements. Specific educational goals have to be set. Ethical rules of conduct of judges in the Czech Republic This master thesis deals with ethical rules of conduct of judges in the Czech Republic. I chose the topic because in this area there is lack of scientific literature given to the topic of professional ethics in general and even less literature directly addressing the professional ethics of judges. The main objective of this thesis is to provide the most comprehensive picture of the professional ethics of judges in the Czech Republic and the resources on which it puts. The topic is brought to the reader within five chapters. The first chapter introduces the reader to the topic of ethics and its relation with morality and law and brings the view from the perspective of philosophy and legal theory. The second chapter deals with professional ethics and professional ethical codes, presents to the reader what the professional ethical code should be like. The content of the third chapter is in the first place to introduce the reader to the character and personality of the judge, his status in the legal system and, above all, the analysis of the professional ethics of judges. Representatives and the represented: trust vs. alienation

These days are western democracies in serious crisis. We could observe this crisis in disconnection societal topics, not only, but especially political, from the citizens, who are affected with these topics the most. The citizens are becoming apathetic; they have no interest file their energy beyond their own private and professional life. This situation could develop in two directions. The first way means conservation of current state, status quo, and it leads to not so happy future. Or another way change of course happens and the interest in public life will be activating in the citizens. And I believe in the second possibility. However, there is lot to do, to revise many aspects of public life, e.g. political parties, funding to these parties, institute of representation and how community perceive it, or elections, the way legitimation.
The impact of media on judicial determination in cases of traffic crimes

Media influence over court rulings in traffic crime cases The aim of this thesis is to analyze the way media report about traffic crimes and provide a comparison between cases that attracted media attention and cases that didn't. The author investigates the possibility that courts are influenced in thein decision making by the general public, the opinion of which is shaped mostly by mass media outlets which unfortunately often release speculations as proven facts. To demonstrate the possibility of media influence to the reader, the author compares similar cases and shows how different the court ruling was when the case wasn't a subject of attention of mass media. Part of this analysis consists of a letter to the judge who presided over one of such cases, the incident on D1 motorway in 2010. The conclusion is that there's potential for such influence, but it's impossible to be absolutely certain that it already exists. The threat of such influence will, however, grow over time as new technologies are introduced, that make it very easy to spread information and consume it. Interception - a public issue? Publishing the records of police in mass media

The focus of my thesis is the issue of publishing police wiretaps in mass media. The work is divided into four parts. The first part deals with the role of mass media in today's society and its influence on politics and democracy. All of which from a media studies point of view. It also focuses on infotainment as I consider publishing wiretaps as one of the most significant manifestation of this growing trend. The second part explores mass media from a legal point of view. It describes the current state of media legislation and self-regulation. Basic terminology and the rights and responsibilities of journalists are defined in the chapter. Using the test of proportionality, it explains how courts decide when the freedom of expression and the right to privacy collide. Decisions of the Czech Constitutional Court and the European Court of Human Rights are frequently cited in the work for a better understading of the issue. The third part is an analysis of various aspects of police wiretapping pursuant to the Criminal Procedure Code. Apart from legislation, it describes the practical aspects of wiretaps handling. Enforcement of maintenance collection in regard of efficiency of the functioning of law in a society

This dissertation thesis "Enforcement of maintenance collection in regard of efficiency of the functioning of law in a society", deals with the term of the law impact efficiency in the society and its practical effect on the institute of prosecution of a maintenance collection, focused on maintenance collection for minor children. The dissertation aims to analyze the process of the enforcement of the maintenance and to examine its efficiency. This dissertation is elaborated mainly on the basis of the Czech academic literature, the newly amended laws, the reliable printed and online sources and the germane court's interpretations. The dissertation consists of three chapters, which are further divided into subchapters. The first chapter provides description of the institute of the maintenance from the Czech operative law point of view. The second chapter deals with the problem of the law impact efficiency itself in the society. It defines the theme itself and describes its main barriers in regard of the institute of the maintenance. The third chapter examines the problem of the efficiency of the enforcement of a maintenance collection. The conclusion of the dissertation summarizes ascertained knowledge and examines the efficiency of the enforcement of a maintenance collection.
Dollfuss and Schuschnigg,s Austria - case study of authoritarian regime

The aim of this thesis is to analyze the authoritarian regime in Austria in the period between the two world wars. This thesis consists of three chapters. The first is the theoretical basis of this work, as I present the various concepts of authoritarian and totalitarian regime. The second chapter then follows the developments in Austria since the end of World War II until the fall of democracy. The focus of this work is the third and final chapter, which analyzes the authoritarian regime between the years 1933-1938. Based on the information provided I am giving an answer to the question what was the specific character of the Austrian regime for government of Chancellor Dollfuss and Schuschnigg, and why there was a fall of democracy in the conclusion.
