Presumption of Innocence

Presumption of Innocence: Possible Limitation and Obstacles to Fulfillment Abstract The presumption of innocence is one of the oldest legal principles, a guarantee of an objective approach to the accused in criminal proceedings and a human right. This thesis deals with the concept, content and history of the presumption of innocence and its embodiment in law and nature, not only from a legal point of view. The author comes to the conclusion that the presumption is not of absolute nature and it is possible to limit it in order to preserve other values. The main topic of the thesis is the issue of the possibility of limiting the presumption of innocence. Based on the analysis of ECtHR and Constitutional Court jurisprudence and opinions of experts, the author comes to the conclusion that the presumption of innocence can, under certain conditions, be limited in a permitted manner firstly by placing the burden of proof on the accused, secondly as a result of the statutory regulation of proceedings on extraordinary remedies filed in favor of a deceased convict and thirdly as a result of the accused pleaing guilty. Terminology management in the institutional settings and the creation of terms for the IATE database

This thesis deals with the management of terminology in a multilingual institutional environment, with an emphasis on the organisation of terminology work in the institutions of the European Union, and includes a contribution to the project of Terminology Coordination Unit of the European Parliament Terminology without Borders. The theoretical part first describes the role of terminology in a multilingual institutional environment, defines the basic concepts of terminology work, and introduces the main international terminology standards. It then discusses the topic of terminology management in the institutions of the EU, in UN, and NATO, and inter-institutional cooperation in this area. Based on the gathered information, a professional profile of terminology staff in the institutional environment is drawn up. The European Union's terminology database IATE is also thoroughly discussed. The empirical part of the thesis focuses on the workflow for the preparation of terminological entries in the field of complementary and alternative medicine for the Terminology without Borders project, which serves as an illustration of the process of preparing terms for the IATE database.

The bachelor thesis consists of a translation of one chapter from the book Lamaistische Tanzmasken by Werner Forman and Byambyn Rinchen. The source text deals with Mongolia, life in a monastery, the life of Mongolian nomadic cattle breeders, Lamaistic dance masks, the history of the Cam and the Erleg Cam. The commentary consists of a translation analysis of the source text, a typology of translation problems and translation and expression shifts. All theoretical information is based on examples from the source and target text. The aim of this thesis was not only to translate while preserving the function of the text, but also to explain the translation solutions. The Tschechische Bibliothek translation project as part of translation history

This thesis deals with the Tschechische Bibliothek project in the context of sociology and the history of translation. Tschechische Bibliothek is a German-language library of Czech literature comprising 33 books published between 1999 and 2007 by the publishing house Deutsche Verlags-Anstalt as a project of the Robert Bosh Foundation (Robert Bosch Stiftung). The aim of this thesis is to map the process of the library's creation from the project's inception, selection of works and publishing policy in the publishing house DVA through the work with the texts (translations, editing, proofreading, paratexts), their subsequent editing (graphic design, typesetting, printing) and dealing with the finished books (promotion, funding) to the reception of the library in both the German-speaking and Czech environments. In pursuing this aim, this thesis focuses above all on the fields of sociology of translation (the influence of the individual participants on the process of creating the library) and the history of translation (the influence of contemporary translation norms and conventions on the work of translators and editors). The translated text comprises two chapters of the book Günter Grass: Schriftsteller - Künstler - Zeitgenosse, Eine Biographie by the German author Volker Neuhaus. The book focuses on life of German writer and artist Günter Grass in relation to the German history in the 20th century. The bachelor thesis consists of the actual translation and a commentary, which contains a translation analysis describing the used translation method, shifts made during the translation process, and the ways of solving encountered translation problems.

The thesis called Josef Jungmann - Translator from German, from the history of translation field, addresses the main characteristics, methods and techniques of this important figure of the Czech National Revival in his translations from German literature. The thesis stresses the context of the National Revival period, its norms and functional translation analysis of selected translations based on the model of Katharina Reiss. Out of the linguistic and cultural works of Josef Jungmann (1773 :___ 1847) the thesis focuses on the translations of ballads and poems by Gottfried August Burger Lenora - Lenka (Lenore), by Johann Wolfgang Goeth Píseň milostničky (Mignon), Čarodějnický učedlník (Der Zauberlehrling), Zpěv duchů nad vodami ( Gesang der Geister iiber Wassern), by Johanna Gottfried Herder Kůň z hory (Das Ross aus dem Berge) and by Friedrich Gottlieb Klopstock Vyučenec Řekův (Der Lehrling der Griechen). The thesis then focuses on the translation of Goethe' s idyllic epos Heřman a Dorotka (Hermann und Dorothea) and the translation of libretto by Gottlieb Stephanie based on the play by Christoph Friedrich Bretzner Únos ze serailu (Die Entfiihrung aus dem Serail).
Christian Morgenstern in Czech translations

There have been many translations of Christian Morgenstern's work and, in particular, of his "Galgenlieder" into Czech. The first translations appeared in magazines in the interwar period. "Palmström", translated by Ludvík Kundera (born 1920), was the first Czech translation of an entire collection of Morgenstern's poems. This book was published in 1944 in samizdat. Another samizdat version of "Palmström" appeared in 1951, translated by Egon Bondy (born Zbyněk Fišer, 1930 - 2007). The 1950's saw more translations of Morgenstern into Czech: by Josef Hiršal (1920 - 2003), Bohumila Grögerová (born 1921). These translations appeared in 1958, 1964, 1965 and 1971 and selections from them were published even afterwards. Translations by Emanuel Frynta (1923 - 1975) from the same period were included in the "Moudří blázni" anthology. Rudolf Havel (1920 - 1993) made his translations of Morgenstern in the 1970's and 1980's. They were published posthumously in 1996. The aim of the present thesis is to examine the translation methods of the individual translators. Recognition of 3D objects with uniform surface reflectance

A new approach based on the edge examination has been developed for the detection of polygonal structures as an alternative to MSERs and Harris points. The recognition of objects with a uniform surface was the initial motivation. The detected polygonal structures can be used as supplementary features for the nonuniform object recognition as well. Finally, the method has been tested on the real application of the viewpoint invariant car license plate detection. The main contribution of our approach is the ability to detect polygons regardless to their size, number of vertices and orientation. The polynomial time complexity for low polygon degrees allows our method the real-time performance. Moreover, the searching algorithm can be modified to find more types of polygons at a time very easily.
