International sales contract
Staňková, Monika ; Pauknerová, Monika (advisor) ; Brodec, Jan (referee)
The thesis is called international sales contract. The aim of it was to provide an overview of the possible legal regime of an international sales contract and to inform about sources of law that are applicable to such contract. The main aim of my thesis was to analyze United Nations Convention on Contracts for the International Sale of Goods (CISG). I tried to evaluate its advantages and disadvantages through the whole thesis. I focused on its scope of application, on the other hand, I did not examine rights and duties of parties to a contract determined by the CISG. In one part of my thesis I also paid attention to INCOTERMS, which is a significant and practical tool on the field of international trade. I realized this thesis using a descriptive method, since I tried to characterize certain legal instruments and their position and function thanks to information obtained from legislation, doctrine and case law. Moreover, I was using a comparative method, as I was comparing differing opinions of doctrine. Afterwards, I tried to form and explain my own views. I divided my thesis into five sections. In the first section I described international sales contract and I pointed out the difference between international and domestic sales contract. In the second part I was dealing with sources of law of...
Political Mobilization in the Czech Republic after 1998: Role of the Protest Movements and Initiatives in the Society
Staňková, Monika ; Just, Petr (advisor) ; Šušlíková, Lada (referee)
The mass character of political mobilization is not the only measure for the strength of civil society. It turns out that, in post-communist countries including the Czech Republic, transaction capacity became the characteristic of protest movements and initiatives. It referrs to the ability to cooperate, take advantage of inter-organizational network and share resources and know how. These transactions, to a certain extent, compensate for poor mobilization capacity, which is typical for new transactional activism and civic self-organizations. The contrast between "old" social movements, episodic mass mobilisations, new transactional activism, along with civil self-organization, illustrated that even without mass mobilization a mature structure of civil society and advocacy organizations can emerge and operate. The year 1998 brought the beginning of favorable conditions for political activism. It turns out that the activity of the "old" activism decreases with the number of members of trade unions, which is typical for this mode. At the same time, people prefer forms of direct action and direct public protest. Using five selected case studies we described the nature of episodic mass mobilization, civil ad hoc and informal self-organization and new transactional activism, whose repertoire is besides petitions...

The diploma thesis is divided in two chapters, the first chapter discusses alternative disputes resolution and the second chapter analyzes arbitration. Within the second chapter, the attention is focused on the concept of arbitration, its contemporary regulation and types, arbitrability, arbitration ageement, arbitrator, principles, process and ending of arbitration.
