In Search of a Competition Law Model for ASEAN through a Case Study of Singapore, Malaysia and Vietnam: Does the EU Competition Law Model Fit? Abstract The thesis aims to identify a fitting competition law regime for ASEAN countries. It operates upon presumption expressed in the scholarship on legal transplanting and competition law and development that for a transplanted competition law to be successful, it has to be tailored to fit the domestic environments. As the thesis observes that in adoption of their competition regulation, ASEAN member states resorted to legal transplanting of competition models from other jurisdictions, especially that of the EU, tailoring the EU model to fit their domestic conditions seems to be a key to their success. These differences in domestic conditions resulting in different national competition laws will also influence the design of a region-wide competition law regime that is being constructed. To identify those market-related needs and pain-points of ASEAN members states, the thesis classifies them into clusters depending on their level of economic development. Singapore, Malaysia and Vietnam (the examined jurisdictions) were selected as representatives of the economies of ASEAN member states from the most developed to the least developed ones. The thesis first analyses...

Kocí, Miloš ; Král, Richard (advisor) ; Petr, Michal (referee) ; Šmejkal, Václav (referee)
Leniency programmes and private enforcement of cartel law The available data suggests that there is an indisputable correlation between the declining attractivity of the leniency programme of the European Commission on the one hand, and the recent boom of private enforcement of cartel law on the other. It seems that in the past few years companies have become demotivated to submit leniency applications, which leads to a lower level of cartel detection and ultimately results in the weakening of both the public and private pillars of cartel law enforcement. This thesis focuses on areas that have not yet been sufficiently clarified by legislation and case-law and that are - when it comes to follow-on proceedings dealing with damages claims, held before national courts - associated with substantial risks for potential leniency applicants: (i) establishing of jurisdiction of national courts in the proceedings on claims for damages caused by anticompetitive conduct, (ii) protection of confidential information within the framework of hybrid settlements with the European Commission and in the proceedings before national courts, (iii) interpretation and application of presumptions of the existence and amount of harm caused by anticompetitive conduct and (iv) determination of the amount of harm caused by...

First charter of the thesis is devoted to trace history of capital markets in order to illustrate their importance and specific function throughout last centuries. We discuss separately their development and evolution in the Czech Republic and in the rest of the world. In particular, we focus on European legislative framework and its significant changes in last decades as it substantially influences inland law. For this purpose we also consider conclusions of the final report of the committee chaired by Alexandre Lamfalussy which affected the European legislative. In the second part we define investment instruments which are traded on the regulated markets. The second part of the thesis discusses in detail causes of regulation and supervision with particular focus on the Czech Republic. We argue inevitability of the supervision and consider its optimal extent. The next part analysis regulated markets in the spirit of its...
