Comparative study of trademark law in legal systems of the Czech Republic and the Peoples Republic of China

This paper compares legal systems of trademark law in Czech Republic and Peoples Republic of China with focus on trademark legislation. The goal of this thesis is to provide the reader with a view of Czech and Chinese mentality towards trademarks as it evolved in time. This historical comparison of trademark evolution should mainly serve as a guideline to understanding as to why each legal system chose such legislation even though both are part of the civil law system. Another goal is to present the reader to a complete view of Chinese trademark legislation with focus on those aspects that are the most different for Czech trademark legislation and also to present specifics of Chinese and Czech trademark legislation which would be hard to find in its counterpart. This thesis is divided into three chapters. The first chapter describes the basic concepts that are essential to this thesis, with focus on those, that are significant for the comparison of both legislations. Community trade mark and obstacles to its registration

Resumé Community Trade Mark and Impediments to Registration Trademarks take important and still more preferred part of entrepreneur legal protection portfolio. The effects of European integration are partially visible in corresponding approximation of national trademark law of member states. The remaining barriers of cross- border undertakings in whole European Union were substantially mitigated by this new legal instrument, which grants its proprietor an exclusive right to prevent unauthorized use of the mark in trade without his consent. This diploma thesis deals with possible impediments to registration of Community trade mark. For an entrepreneur, it is crucial to know whether he may reasonably expect, that his trademark application will remain unchallenged. Therefore, the question must be raised on whether the mark is registrable as such. Since this is not the only nor the most frequent issue, the focus is made on the conflict with earlier rights as well. 58 RESUME Community trade mark and its relationship to national trade mark, especially with regard to accession of the Czech Republic to the European Union Protection of intellectual property plays an important role in creating the legal framework for business and thus affects the functioning of the internal market within the territory of the Member States of the European Union ..
