Audiovisual Works Abstract: The thesis deals with the private legal regulation of audiovisual works, which is primarily contained in The Act No. 121/2000 Coll. (Copyright Act) and The Act No. 89/2012 Coll. (Civil Code). It analyzes this legislation and points out some problems arising from the interpretation of the law, also with regard to the audiovisual practice. The thesis is composed of eight chapters, each of them dealing with different aspects of audiovisual works. Chapter One is introductory and it contains list of sources of legal regulation of audiovisual works and defines the term of an audiovisual work. It also deals with authorship of the audiovisual work regarding some interpretative problems connected. Chapter Two examines another important term of audiovisual field - a work audiovisually used - and it focuses also on the authorship of works audiovisually used. The thesis discusses inconsistencies arising from an absence of the legal definition of this term in the Copyright Act. The third chapter concentrates on performances audiovisully used. It defines the term of an artistic performance regarding to the audiovisual practice. Copyright Aspects of International Trade in Works of Art My thesis deals with copyright aspects of international trade in works of art. I decided to elaborate the theme due to my interest in the study of copyright and the international art market. The issue is explored mainly through overview of the relevant international, EU and Czech legislation. The work is introduced by historical development of the copyright and excursus to the development of international trade in works of art. This study aims at analysing of the copyright aspects of international trade, not international trade law and private international law, even they affect the copyright aspects of international trade undoubtedly and both are crucial for this field. But if necessary, in spite of its copyright focus my thesis interferes in this area too. Breakdown of my work is based on a systematic examination of the issue described. Film Law: A Copyright Perspective (Abstract) The rigorous work describes and analyses the film law, understood as a set of norms of public and private law, bound by common denominator in the form of direct or indirect regulation of production and exploitation of film, with a special focus on film copyright. The work focuses on contemporary and historical treatment of the film copyright in the Czech Republic, while in some parts performs its comparison with the film copyright in other countries, particularly in the United States of America. The first section defines the general mutual relations between film and law, especially in terms of copyright and the right to freedom of expression. Inter alia, it also deals with the question of film as "art", and how this issue plays a role in its legal regulation. The second part of the paper specify the basic terms and concepts which could be found in the film law as well as in the practical film production and distribution itself governed by this law. The goal of this diploma thesis is to provide an overview of the increasingly more important world of copyright protection as it concerns computer programs. The focus of this overview being primarily that of the national law of the Czech Republic, however this diploma thesis takes into account international law where applicable as well. The thesis begins with an introduction into the very concept of copyright law, the definition of a copyrightable work and that of computer programs and terms related therein. What follows is a brief account of the history of computer programs and computer programing in general as a basis for the following legal perspective into the matter. An international overview of the subject matter follows, including a look at key moments from an international perspective at the field of copyright protection of computer programs, including a brief overview of the Berne Convention, the TRIPS Agreement as well as aspects of European Law. - CONTRACTUAL COPYRIGHT LAW This theses deals with contracts in copyright law. Its main aim is to describe legal regulation concerning most frequent types of contracts in copyright law and to compare the regulation of these contracts as it was before the recodification of Czech private law, which was done by the new civil code, with the state after it and to mark out main terminological and conceptual changes, which have some connection to contractual copyright law. The work consists of eight chapters. The first chapter contains a brief overview of domestic sources of contractual copyright law. The second chapter explains some basic concepts of copyright law which have some relation to the contractual law - the concepts of authors' rights and prohibition of its transfer to other person and terms of license and consent in copyright law. In this chapter reader also finds subchapters on new legal definition of things and ownership in the new civil code and how these new definitions influence copyrighted works and license agreements. The main goal of this thesis is to analyse to what extent piracy on today's Internet is spread; who is responsible for unlawfully shared files from the legal point of view; how it is fought against copyright infringement; how it is possible to identify a person being responsible for copyright infringement and with what kind of punishment the person is to be charged. Moreover, this thesis focuses on in what way the issues mentioned above could develop and presents an outline of legislation changes which would lead to more effective copyright enforcing. The main reason why I have chosen the topic "The Internet and copyright - the scope of responsibility of particular subjects (webhosting, the Internet provider…) and means of protection against piracy (the pirate identification and their punishment…)" is that I find this law field very dynamic and likely to develop further, which makes it appropriate for my future career. What is more, I am close and interested in IT myself. I also believe that the real "boom" of lawsuits has not come to the Czech Republic yet resulting in a good opportunity. Herein presented thesis focuses on a very complicated relationship between the Internet and selected law areas. Its aim is to emphasize the influence of information technologies on law; specifically it examines challenges which these technologies present to the copyright law and data protection. The thesis is divided into five chapters. The first and the second chapter with respect to the comprehensiveness of the topic, which they describe, do not have ambitions to analyse the issue in detail; they rather present it in broader and more general context. On the other hand chapter three and four discuss specific data protection and social network issue much deeper. The conclusion of the paper is considered as a certain summary and demonstration of author's thoughts and opinions towards analyzed issue. The first chapter aimed to describe specific environment of the Internet including its origin and development. Copyright protection of computer programs This thesis deals with copyright protection of specific works of authorship - computer programs. The thesis deals with the definition of works of authorship and the conditions in which the computer program is a work of authorship, at least as a legal fiction. For the term computer program, the thesis is trying to find a suitable definition that is sufficiently general, but also accurately captures it's notion. Various known forms of expression of the computer program (source code, machine code, but also a code in an intermediate language) are described and the thesis explains, why it is appropriate to protect the computer program in any form. The thesis clarifies, why the term "software" and the term "computer program" are not identical and arbitrarily exchanging them can cause problems. Furthermore, the thesis deals with the author of the computer program and co-authorship. The next part deals with the rights of the author of the work. The exclusive rights of the author (the moral rights of the author and copyright) are discussed. Collective management of musical works in Czech Republic

The subject of this thesis is Collective management of musical works in Czech Republic. Copyright law is specific area of Intellectual property law that protects copyright works. Intangible character of copyright law is the reason of lower level of possible protection by the right holders themselves. This is the reason why copyright holders unite in associations so called Collective management associations (CMA). CMA can ensure better protection than right holders themselves and push ahead their interests. CMA acts in their names but on the account of the right holders. CMA mainly protects two types of rights- mechanical rights (reproduction, renting etc.) and performing rights (concerts, background music etc.). Because of worldwide boom of internet piracy, income from mechanical rights in the beginning of 21st century drastically declined. In accordance with this trend declines the importance of mechanical rights in their original form. That's why this thesis is concern mainly on performing rights that are connected on communication to the public.
