Legal aspects of economic integration of the European Union and the Eurasian Economic Union

This thesis is devoted to the analysis of two major unions- the European Union and the Eurasian Economic Union (EAEU). The aim of this work is to compare single stages of their integration process with an emphasis on how the experience of EU has influenced the integration process of the EAHU. The first chapter describes the history of the European union with regards to legal and institutional aspects. This part also examines treaties of the EU signed at each step of integration. The second chapter is dedicated to the integration processes in the countries of the former Soviet Union which led to creation of the EAHU in 2015. The third chapter provides a comparison of the previously described processes in two regions, emphasizing simularities and evaluating the prospects of cooperation between the unions.

The Action for failure to act governed by Art. 265 TFEU

This thesis deals with the action for failure to act which is governed by Art. 265 TFEU. The purpose of the action for failure to act is a defence against unlawful failure to act of institutions and bodies of the EU. I describe an action for failure to act, define the conditions of admissibility, compare the action for failure to act to the action for annulment and analyse the decisions of the CJEU. The aim of the work is based on theoretical findings and analysis relevant decisions of the CJEU to determine the reasons for the low success rate of the action and try to formulate rules for bringing an action so that the present action was successful.
Violation of environmental standards by companies based in the EU

In this bachelor thesis are discussed in detail selected types of pollution - air and soil pollution. The work mainly focuses on two currently most socially debated environmental cases: 1) excessive production of emissions via vehicles manufactured by Volkswagen 2) the use of harmful chemicals in agriculture by Monsanto The thesis stresses the need to protect selected areas of the environment. It analyses the causes of the origin and also the development of given affairs. Then it seeks eventual solutions of the problems. The first chapter contains a theoretical concept of the issue - a brief chronological overview of the development of standards and a description of the bodies of the European Union in relation to the protection of the environment. The second part defines the protection of air from a broader perspective, and then specifies the car case more in detail. The third part focuses on soil conservation - on the general analysis of the issues, but also on specific points of the selected case.
Case-law of the Court of Justice of the EU related to asylum law

The objective of this Bachelor thesis is to ascertain, whether is the asylum law used correctly and effectively within the European Union. The first part is devoted to the development of the european asylum law since the fifties up to the present day. In this section are described primary sources of law as well as secondary sources of law, which constitute a kind of a foundation for the crucial part of the thesis - Case-law of the Court of Justice of the EU. Based on a detailed analysis of chosen judgments of the CJEU related mainly to the examining of asylum applications is discovered, which regulations are problematic and where it is necessary to improve the legislation. Besides the analysis, method of comparison is also used, especially in comparing the sources of law with its practical application. The summary of the findings recorded during creation of this thesis are situated at the final section with recommendations that could contribute to establish a real and united Common European Asylum System.
European legislation of novel food

The thesis deals with legal aspects of novel food in EU, it brings also American point of view. Theoretical part of the paper is focused on the comparisn of the old legislation of novel food with new one, which will be applicable until 2018. Another point in the theoretical part is charasteristics of EFSA and FDA institutions. In the practical part specific examples of novel food and their characteristics are defined there. Last point of the practical part is based on judicature.
Schengen System and Current Issues of its Realization

The aim of this diploma thesis lies in detail description of the whole Schengen system including its links to the general EU legal framework and in critical analysis of selected issues that the Schengen system is currently facing. The first chapter of the thesis deals with a general legal framework of the free movement of persons and the area of freedom, security and justice. The second chapter is devoted to the formation, development, actual legal framework and territorial scope of the Schengen system. Further there is a detail description of schengen cooperation with emphasis put on the protection of external borders and FRONTEX agency. By using a journal articles and relevant case law of the Court of Justice of the EU the third chapter is aiming to analyze selected issues of realization of Schengen system and to name its current challanges.

Competence of the European Union to Regulate GMOs

The thesis is devoted to legal regulation of genetically modified food and feed in the European Union. It tries to answer the question: whether and how to regulate use of GMO and the future of the regulation. Considerations are supplemented by European jurisprudence. The work also provides dispute between the European Union and the World Trade Organization concerning the adjustment of the use of genetically modified organisms. Based on available information, thesis leads to inviolable of the protection of the European consumers after the effectiveness of the Transatlantic trade and investment partnership between the European Union and the United States.
The Member State liability for the infringement of EU law- the legislation of Czech Republic

The institute of Member State liability for damages caused to individuals as a result of a breach of the European Union (EU) law represents the process of strengthening of the individuals rights in the context of European integration. The Czech Republic is obliged to apply defined legal provisions of EU law as it has been an EU member for more than a decade now. Therefore, a larger part of this work deals with the State liability at the EU level. At the same time, the thesis analyzes the specific features of the Czech national legislation related to this particular issue. The main objective of this bachelor thesis is based on the analysis of relevant sources to define and to assess, to which extent is the Czech republic liable for a breach of EU law and moreover to provide a coherent framework of the above-mentioned institutes establishment.
