Withdrawal from a contract as a means of consumer protection under private law

The right to withdraw from a contract as a way of individual legal protection of the consumer Abstract The core of the research is a new right of the consumer to withdraw from a concluded contract without reason and confronting with foreign legal regulations. The aim of the work is to describe the nature of this right and possibilities of the legal- dogmatic construct and the method of its regulation, the performance of this right and its legal consequences. The work is based on the comparison of the European legal regulation and three harmonized regulations - Czech, German and Austrian. The right of the consumer to withdraw from a contract means the interference with the contractual freedom of the parties and breaking the principle "pacta sund servanta" in favour of the autonomy of the consumer. It is possible only in certain situations and certain types of contracts and it presents a new law-making technical way of individual protection in contract law. The problem of the Czech regulation is a harmonious incorporation of the content of the regulations into the system of the Civil Law so that it is correct and understandable for the recipient.
