The Environmental Impact Assessment: - A Comparison of Legal Regulation in the Czech Republic and the Commonwealth of Australia

This research paper summarizes legal regulation regarding Environmental Impact Assessment in the Czech Republic and Commonwealth of Australia. Both these countries recently enacted amendments to the current regulation or taken steps to implement changes of this process in order to make it more efficient in term of costs of the proceedings and also in terms of more quality protection of the environment. Right to environmental information in the context of a free access to information

The subject of the thesis is right to information on the environment in the context of the free access to information. It is a progressive area of international law and czech law as well. Their common aim is to guarantee right to information to everybody without exceptions and to remove effectively the obstacles in access to the information. Environmental information are useful instrument for establishment and strengthening of civil society. This thesis aims at anaylising the content, importance and position of all the principal sources of law and determines relationship between them. The thesis puts emphasis on the analysis of the czech law and on finding its possible deficiency.
Maintaining the Land Register in compliance with the actual situation

The Land Registry is one of the largest information systems with extraordinary requirements on the accuracy and reliability of the data in it. The seeking and repairing the incorrect data in Land Registry is the up-to-date charge aimed to improve the status of the land registry data and in this way strengthen the sureness and confidence of the owners related to the Land Registry. In my work is described the process how to solve erroneous data in the Land Registry. This effort has the aim to keep the Land Registry in conformity to all laws, documents and other data, which were put to the Land Registry to keep it up-to-date. The situation in terrain, in reality is obliged to be in perfect correspondence with the one registrated in Land Register, too.
Legal regulation of treating animals in human care

This diploma thesis deals with legal regulation of the treatment of animals under human care. It provides a comprehensive overview of international legislation, European legislation and also Czech laws. On the international level it describes fundamental conventions of the Council of Europe. On the level of European Union this thesis does not omit primary law of the European Union, secondary legislation as well as conceptual tools. On the national level it tries to outline the key regulations governing the treatment of animals. Next it deals with definition of an animal, creature and wildlife, and categorizations of animals. It also also includes a civil nature of the animal. The major Czech law governing the main ways of dealing with animals in captivity this thesis describes the act no. 246/1992 Coll., On Protection of Animals against Cruelty. After defining possible ways of the treatment it does not forget to acquaint with the possible torts for breach of the requirements for the protection of animals, including act no. 40/2009 Coll., The Criminal Code. In conclusion, it briefly describes the status of bodies whose activities relate to the protection of animals.
Right to a favourable environment within the regional human rights systems

The aim of the diploma thesis is the analysis of the right to a favourable environment, or to the protection of the certain quality of the environment with a focus on the regional human rights systems. This diploma thesis is divided into three chapters. The first chapter outlines the evolution of human rights at the universal level and certain related problems that accompany this evolution. The second chapter is concerned with the overview of the human-rights based approaches to the protection of the envrionment which include inter alia the effort for the recognition of the separate right to a favourable environment. The third chapter examines the evolution of the right to a favourable environment, or to the protection of the certain quality of the environment within the regional human rights systems so it concentrates on the control mechanisms of the relevant regional systems and their activity in the area of the protection of the environment. The conclusion deals with the evaluation of the evolution of the right to a favourable environment within the international law, focuses on the comparison and assessment of the common and different features of the regional human rights systems and indicates the future trend.
Role of the non-govermental organizations in the protection of environment

Diploma thesis aims at role of societies (as the predominant legal form of environmental non- govermental organizations in Czech republic) in the protection of environment. Author describes legal base of society as a type of legal person in a czech law and describes diverse roles of societies in the protection of environment in the subsequent part of the thesis. Afterwards, author briefly describes right to information in environmental matters which is a prerequistite for the participation of societies in decision-making concerning environmental matters. Individual forms of this participation are described subsequently with accent on environmental impact assessment. Lastly, access to justice in environmental matters of the societies is described, including possibility of arguing by substantive law in administrative law suits and possibility of asking for suspensive effect of this actions before court and possibility to bring an action against provisions of general character. Relevant judicial decisions are also taken into account in this part.

- 1 - Abstract The theme of the thesis is "Development (building) procedure and environmental protection". Between the aims of this theses belongs analysis of the construction proceeding according to Building act, further especially evaluation of contemporary legal adjustment environmental protection with connection to construction proceeding and disquisition about main instruments in environmental protection. The thesis deals with environmental impact assessment procedure, objections of the participants in construction proceeding, public participation in contruction proceeding and binding standpoints. The thesis is systematically composed of three chapters. The first chapter focuses on legal adjustment and main principles of environmental protection. Chapter two describes object, subjects and particular phases of construction proceeding foccused on building authority activities. The third chapter deals with particular instruments of environmental protection in construction proceeding. Finally, the thesis comprises a summary of contained conclusions.

In accordance with its title, this Thesis Aims to Analyse Legal Aspects of Climate protection. Therefore its structure comprises of Five major sections dedicated to offer substantial amounts of information on the topic of Climate Change and its Protection. The first section describes the Issue of Climate Change, the History of its Protection as well as necessary measures and certain difficulties to achieve a consensus usually occurring during international negotiations. The second, third, and forth sections address Legal Climate Protection at International, European Union, and National Levels. Finally, the closing fifth section not only summarizes all that has been stated in previous sections but also evaluates Efficiency of actions taken at the three levels mentioned. Furthermore, the last section suggests where the major efforts should be focused on in the forthcoming years. Confiscation and the Allotment Procedure pursuant to Presidential Decrees in Czech Case Law

This thesis deals with the reflection of confiscation and the allotment procedure pursuant to presidential decrees in Czech case law. In numerous cases, the allotment procedure has still not been completed or persistent problems arise from it in the area of legal relations to immovables and their registration up to the present day. The thesis analyses and categorises relevant statutory and case law based upon the material criterion. The result is a set of clearly defined thematic groups of the most significant judgements covering the individual problems identified and an analysis of the stability of the case law or the lack thereof in the individual thematic groups.

This diploma thesis deals with the recording rights and other data in the Land Register. This thesis looks at the history and the principles of the Cadastre. Every way of entering in the Land Register is analyzed in the thesis, the text points out changes made due to re-codification of private law. The attention is paid to the entry of legal relations and recording procedure.
