Legal capacity of minors in Czech and German law

This thesis is focused on legal capacity of minors. The main issue is an extent and circumstances under which minors are legally incapacitated to oblige themselves and to influence their own legal relationships. The thesis is divided into four main parts. The first part is focused on general definition of legal capacity and the basic concepts of dealing with limited legal capacity. Second part is dealing with evolution of legal capacity from the foundations set by roman law, it's development on Czech territory to the approval of recent civil code and development in Germany. Third part contains an interpretation of German legislation. I pursue the German legislation first because it is very sophisticated and provides us with plenty of vantage points on different aspects of the Czech legislation. The part dedicated to the German legislation subdivided into two chapters, where the first one focuses on general characteristics of the legislation and the principle of graduated legal capacity of minors and the second part deals with minors without legal capacity and minors with limited legal capacity. The Master's degrese thesis analyse the institute representation in the civil materiál law. It characterises representation globally and tries to digestedly make general scheme which is made on the basis of the legal regulations and second bibliography. The representation in the civil material law could be resolve into the different subsets according to the various conditions. On of the possible ways of the dividing is direct and indirect representation. Indirect representation could be defined as acting of the representant in his own name on behalf of the represented person. Direct representation is acting of the representant in the name of the reperesented person and on its behalf. The rights and the duties come up directly for the represented person. The representation in the civil material law is divided into the contracting representation and the legal representation. Dissertation The Roman Law definitions, maxims, regulas and their reflection to contemporary law This dissertation is focused on research of reflection of The Roman Law sentences and definitions to contemporary Czech law and also to new prepeared legislative regulation of the new Civil Code. The research of single maxims was not mostly carried out separeted, but rather in context of single basic legal institutes. 1 Consumer protection in tourism - abstract The purpose of my thesis is to analyse consumer protection in tourism in European Union law and in the Czech law. The reason for my research is the fact that tourism is currently one of the most important components of the economy of Member States and European Union institutions engaged more and more attention to tourist protection. The thesis is composed of four chapters, each of them dealing with different aspects of consumer protection in tourism. Chapter One is introductory and contains a description of the objectives of this thesis. Chapter Two deals with the sources of the law of consumer protection in the European Union and in Czech Republic. The chapter consists of two Subchapter. Subchapter One consist of two parts. Part One briefly describes the history of consumer protection in European Union and it focuses on the sources of primary law of European Union and the importance of consumer protection as one of the fundament policies of European Union. Private and public law aspects of product liability and general product safety

Resume - Private and public law aspects of product liability and general product safety Product liability, i.e. liability for defective products, is part of consumer protection and in particular consumer protection focusing on consumer health and safety. Product liability is preceded by general product safety since only safety products are able not to cause to consumers damage resulting from products' defects. Therefore it is necessary to get acquainted with both general product safety as well as product liability legislation and judicature. Regarding general product safety there are number of obligations set forth for producers in order to guarantee that only safety products are put into circulation/put into market. Breach of the said obligations is followed by various sanctions in the area of public law as well as private law (liability for damage caused by defective products). Among public law sanctions there belong administrative law and penal law sanctions resulting in punishing producers where a consumer activity is not required in order to punish producer. Czech Act on general product safety belongs among general legislation covering issues that are not covered by special Czech legislation.
