Bitcoin - Legal Aspects and Regulation

in English The motivation for this thesis is to analyze Bitcoin as Bitcoin is still a new phenomenon and requires an economical, legal, and legislative evaluation. In this thesis we seek an answer to the question what is Bitcoin. This thesis is divided into three main blocks, within them we use analytical, descriptive, and comparative methods. In the first part, we aim mostly on the economic side of Bitcoin, comparing Bitcoin to money in general sense. In the second part, we argue whether Bitcoin shall be considered a thing in a legal sense under the Czech law. In the third part, we describe the current Bitcoin's regulatory situation and suggest a drafting of Bitcoin specific regulation. The conclusion of this thesis is that Bitcoin is a digital medium of exchange that cannot be considered money or currency. To the extent, Bitcoin might be interpreted in ways where it does not satisfy the legal definition of a thing in legal sense, but for regulatory purposes it shall be, at least for now, considered a thing in legal sense. We also suggest that Bitcoin shall be systematically regulated by imposing various duties on persons who's scope of business is relating to the Bitcoin.

Financial Aspects of Global Payment Systems Abstract This dissertation summarizes findings on Digital Asset's development, which would fit under the era of Blockchain 1.0. We analyzed and synthetized available resources focusing on the following areas: (i) historic aspects of Digital Assets, (ii) technical solutions of Digital Assets, (iii) actual use of Digital Assets, (iv) abuse of Digital Assets, (v) Digital Assets' legal integration, (vi) Digital Assets as a global payment system. Analyzing history of Digital Assets, we summarize that Digital Assets were developed with the intent to liberate payment systems from existing financial supervision. Once such system became functional it was immediately abused. In connection with technical solutions, we find that as technical complexity of Digital Assets (especially the lack of the trusted third party) diminishes protection of Digital Assets users, it incentivizes criminal activity. Consequently, Digital Assets are vastly abused for different criminal purposes, including development of services dedicated to criminal activity, such as Dark Web Marketplaces or Digital Assets Mixer. Ecology of the Dice snake (Natrix tessellata) in the Chrudimka River

The dice snake, Natrix tassellata, is legally declared a critically endangered species in the Czech Republic. The history of the herpetologically and conservationally remarkable population on the Chrudimka River is short and fragmented in literary records - first records from the middle reaches of the Chrudimka are from the 1970s and from the lower reaches, they're only from the1990s. Until now, there was no detailed population data, only observations that tended to include mostly single specimens. This thesis therefore focuses on the size, composition and dispersal of the Chrudimka population, on obtaining relevant morphological, ecological, ethological and genetic data, and on identification of important landscape features and threatening factors as a basis for the conservation of the local population. Results from the field data collected in 2019-2021 indicate a viable population with annual reproduction. Based on estimates using a capture-recapture method, the population of the lower reaches of the river in the Pardubice region numbers 220-440 adults. The hibernation site used by the majority of the population is located in the Nemošická stráň PP, with the main hunting grounds located downstream of the weir on the Nemošice river and in the nearby oxbow lake. Phenotypic and molecular approaches in the systematics of the Palearctic and Neotropic tree frogs, Hyla and Osteocephalus (Amphibia: Hylidae)

The systematics and taxonomy of tree frogs of the family Hylidae has undergone turbulent changes both at higher (subfamilies, genera) and lower (species) level during the last decades. The original approach used morphological characters to distinguish tree frogs. It has been completed by bioacoustics, since the advertisement calls of the males were in some cases found to represent an important behavioural reproductive barrier and therefore useful for systematic evaluations. However, a completely new impulse was given to systematics by the introduction of modern genetic methods. These methods have allowed to distinguish not only morphologically but even acoustically cryptic taxa. The most reliable method to distinguish tree frogs at present is a combination of data from the different disciplines. The present dissertation thesis aims to evaluate the systematics of tree frogs of the genus Hyla from Eastern Europe and the Middle East as well as the systematics of the Amazonian genus Osteocephalus using a combination of morphological, bioacoustic and molecular approaches. Ecology,ethology and variability of european green lizard Lacerta viridis in Natural reservation Tiché údolí

The european green lizard, Lacerta viridis is a critically endangered reptile species which is in the region of Bohemia present only in relict isolated populations. These populations are closely linked to slopes with a southern exposition in deeply engorged river valleys. These valleys exhibit a unique climatic effect also known as the river phenomenon which allows numerous animal and plant species to survive far beyond their standard northern range. The chosen locality in Tiché údolí is a subject to long-term conservational management and the studied lizard population seems to reflect its effectiveness. This study is aimed to evaluate variability, ecological and ethological characteristics of lizards within the locality and is focused on changes on the population level. Systematics, Phylogeny and Biogeography of the gecko genus Hemidactylus (Reptilia, Gekkonidae) in Arabia and the Near East.

(in English) Until relatively recently, the gecko genus Hemidactylus was considered to contain only several hard-to-distinguish species in the eastern Mediterranean and the Arabian Peninsula. This was mostly given by the apparent morphological uniformity of the geckos in combination with their often synanthropic lifestyle, which facilitated the dispersal of some of the species over large ranges. However, our understanding of the diversity of the genus was about to change with the onset of molecular phylogenetic methods that became extensively available and routinely applied to tackle the questions of systematics and phylogeny of all kinds of organisms. This thesis focuses on resolving the phylogeny, systematics, and biogeography of the Arabian Hemidactylus. Using an unprecedented sampling of over 500 samples of more than 40 Hemidactylus species from the eastern Mediterranean, Arabian Peninsula, Socotra, North and East Africa and Iran and sequencing up to six genes (two mitochondrial - 12S rRNA, cyt b; four nuclear - cmos, mc1r, rag1, rag2) I reconstructed the time-calibrated phylogeny of the arid clade of Hemidactylus, inferred its complex biogeographical history in the region, and detected seven potentially new species. Behaviour and ecology of leopard geckos (Eublepharis macularius)

During evolution, the natural selection favours individuals with the best survival strategy and the highest reproductive success. From the evolutionary point of view, hybridization plays an important role in the process of speciation. Avoiding predators by choosing the most appropriate antipredator strategy increases the animal's chances of survival as well. Studying fitness consequences of hybridization and predation in Eublepharis macularius (Eublepharidae) was the main objective of this theses. Compared to other vertebrate groups, the reliable records on hybridization and its effect on the hybrid's fitness (fertility, survival) in lizards are scarce, despite their ability to hybridize between genetically distant species. These effects were examined in two species of eyelid geckos (E. macularius and E. angramainyu). We aimed to discover whether they were willing to hybridize with a heterospecific species and how the fitness of the hybrids would be affected. Similarly, were studied more genetically related forms of E. macularius species complex, the potential precopulatory barriers, and fitness cost of this hybridization.
