Testaments in Jihlava during years 1578-1590. (History of family and household, historic demography and sociotopography)

Studium testamentů začíná mít v posledním desetiletí mnoho příznivců z řad naší odborné veřejnosti. Ne neprávem. Postupem času se ukazuje, že dochované, leckde téměř nepřetržité řady testamentů z různých měst českých zemí v sobě skrývají další a další netušené informace pro pochopení života měst i jejich obyvatel ve své každodenní realitě. Zároveň JSou vedeny kriticky zaměřené diskuse o metodologických otázkách, spjatých s takovým studiem. Příkladem mohou být i četné příspěvky a podněty, které zazněly na první konferenci věnované speciálně tomuto problému, která se konala v HÚ AV ČR 30. listopadu 2005 pod názvem "Pozdně středověké testamenty v českých městech". Tato problematika se stala i předmětem mé diplomové práce. Na jejím začátku stálo překvapivé zjištění, v jakém množství a zároveň neuvěřitelně celistvé podobě jsou zachovány testamentární zápisy přesahující několik staletí, jež jsou uchovávány ve Státním okresním archivu v Jihlavě. Tato práce si nemůže klást za cíl zhodnocení dané problematiky ve své celistvosti a úplnosti, ani pro podmínky v kontextu místně a časově vymezených limitů tématu, tedy Jihlavy v letech 1578-1590. Kromě základních informací, vztahujících se k diplomatickému zhodnocení pramenů a právním otázkám testamentární praxe, bylo přihlédnuto ke třem oblastem studia, jež spolu do...

Relocating registered office of a business corporation within the European Union

The idea of internal market is one of the basic concepts of the European integration. The internal market of the European Union is a single market in which the free movement of goods, services, capital and persons is ensured. This thesis focuses on the free movements of legal persons in the European Union, namely freedom of establishment and the possibility of cross-border transfer of a company's registered office. This business focused freedom is regulated mainly by primary law in Articles 49 a 54 TFEU and its main objective is to enable the exercise of economic activities even in the territory of other Member States. The aim of this thesis is to investigate the regulation and development of case law regarding freedom of establishment of companies and give their comprehensive analysis. Furthermore, the thesis points out the fact that the choice of company's seat and its change is often associated with advantageous conditions laid down by national legislation. Companies often choose countries which have minimum requirements for their establishment and existence. States are aware of this behavior. Consequently, some of them reduce their legal standards and try to attract companies into their territory. This may cause the battle of jurisdictions. The Testamentary Practice in Jihlava in the Years 1578 - 1624 (Wills as Sources for the History of Family Structures, Historical Demography and Sociotopography)

THESIS ABSTRACT The subject of the research - the Early Modern burgher will - is viewed in the thesis from the standpoint of family structures, historical demography and sociotopography. The sample of 968 Jihlava wills from the period 1578-1624 were subjected to statistical analysis. Moreover, from a methodological perspective the nature of this research is similar to micro-historical and prosopographical approaches. The aforementioned theme was compared to conclusions of the literature concerning historical demography and family structures (especially English) as well as foreign sociological and anthropological studies. The results of this research were evaluated from the point of view of the annual number of wills as possible indicators of the chief trends in mortality, and possible connections were traced between the number of children named in the testaments and the inheritance system. Given the numerous marriage contracts concluded by testators, the study also looked into the "marriage market" and the duration of marriages. Other questions discussed in the thesis include, for example, family and household positions, disabled people, gender studies and intergenerational property transfer.
