Reconciliation of family and work life in healthcare
Mandíková, Marie ; Štangová, Věra (advisor) ; Tomšej, Jakub (referee)
Reconciliation of family and work life in healthcare Abstract Reconciliation of family and work life is currently a topic of fundamental importance, not only from the perspective of the individual, but also from the perspective of society, as it relates to many issues of societal importance, such as the promotion of equality between men and women on the labour market, increasing the employment of women and motivating young couples to start families in order to increase the birth rate. Although the topic of harmonization of work and family life is currently receiving relatively high attention, and the regulations of labour law and social security law contain a wide range of instruments supporting the reconciliation of family and work life, it shall be remembered that there are professions that are more accessible than others for harmonizing work and family life (especially, for instance, "white collar" jobs, with the possibility of relatively wide flexibility). However, there are also professions in which it is very difficult to imagine an employee working from home or using, for instance, flexible working hours, as the nature of that particular profession does not allow it. This diploma thesis is devoted to the conflict between the legal theory of the harmonization of family and work life with practice in a...
Equal treatment and non-discrimination in employment relations
Malý, Štěpán ; Štangová, Věra (advisor) ; Tomšej, Jakub (referee)
This diploma thesis deals with the principle of equal treatment and non-discrimination in employment relations, with the aim of summarising current issues in this area together with examples from practice, particularly in the context of CJEU decisions. The author also attempts to provide suggestions on how to improve the situation and to summarise the legislation that is applicable in such cases. The first part of the diploma thesis deals with the definition of terms related to the issue and used in the thesis. These are mainly the concepts of equality, discrimination, harassment or mobbing and bossing. Of course, the thesis also includes legal regulations, including Czech, European and international law. The core of the thesis is the analysis of the discriminatory grounds themselves, with the main part devoted to discrimination on the basis of gender and race, ethnic origin and nationality. In the context of gender discrimination, in addition to unequal pay or transgender issues, attention is also paid to sports, where the author emphasises that even in the case of seemingly unequal pay, such treatment can be objectively fair. In the context of discrimination on the grounds of race, ethnic origin and nationality, the central part of this chapter was devoted to discrimination against the Roma...

Ragač, Šimon ; Štangová, Věra (advisor) ; Lang, Roman (referee)
Comparison of the old-age pension insurance legislation in the Czech Republic and the Slovak Republic Abstract The main aim of this thesis is to compare the old-age pension insurance legislation in the Czech Republic and the Slovak Republic, to point out their differences and similarities, and to evaluate their significance. To a lesser extent, the thesis also deals with the theoretical foundations of pension insurance and the historical basis of social security law, which is common to both countries. The thesis is divided into seven parts. The first part introduces social security law as a legal branch and pension insurance as its subsystem. The second part concentrates on the historical development of pension insurance from prehistoric times to the end of the twentieth century. The following three parts of the thesis are focused on the pension insurance system from a point of view of legal theory. They primarily examine relevant legal principles and sources of law, but also individual social events and pension insurance benefits. Moreover, they deal with various options for financing pension insurance and also present its pillar framework. These parts provide an essential range of information that is necessary in order to understand the functioning of old-age pension insurance in both countries. The most...
The pension insurance system and aspects affecting its development with an emphasis on demographic changes
Remešová, Karolína ; Štangová, Věra (advisor) ; Lang, Roman (referee)
1 The pension insurance system and aspects affecting its development with an emphasis on demographic changes Abstract The diploma thesis deals with the description of the current pension insurance system in the Czech Republic and aims to evaluate the pension system on the basis of aspects that affect its development. Demographic development is a key factor influencing the system. The author describes the relevant demographic indicators and their development and presents conclusions resulting from the forecast of population development. In 2021, expenditures on social benefits accounted for 37% of all state budget expenditures, ie CZK 697 billion, of which almost 77% were expenditures on pension insurance benefits in the amount of CZK 536 billion. State budget revenues from compulsory social security premiums represent 41%, ie CZK 562 billion. As these data show, the Czech Republic will face a lack of funds in the future due to the expected aging population, and therefore the author presents possible scenarios in the diploma thesis, where the pension insurance system could develop in the future. A significant part of the diploma thesis is focused on the first pillar of the pension system, ie pension insurance, where the author describes all the concepts arising from the law. In addition to the old-age...
Atypical Forms of Employment
Machala, Jan ; Štangová, Věra (advisor) ; Tomšej, Jakub (referee)
The thesis deals with atypical forms of employment, from their definition, through legal regulation to their use in practice. Atypical employment is a highly topical issue in labour law. This is confirmed by the development in the European Union countries, where an increasingly clear shift from the typical employment relationship model to atypical forms of employment can be observed. Atypical employment can be a tool to promote higher employment rate, flexible adaptation to the requirements of the labour market and reconciliation of work and family life. The thesis consists of an introduction, three chapters systematically divided into subchapters, and a conclusion. The first chapter deals with the development of labour law in the Czech Republic. The second chapter deals with labour law in the sense of its concept, subject and position in the legal system. The core part of the thesis is its third chapter, which deals with selected atypical forms of employment regulated by the Czech legal system. It analyses agreements on work performed outside the employment relationship, temporary assignment, agency employment, temporary employment, part-time work, job sharing and performing work from home. After an assessment of atypical forms of employment, considerations are presented on the possibilities for...

Borovková, Tereza ; Štangová, Věra (advisor) ; Tomšej, Jakub (referee)
5 Reconciliation of professional and family life Abstract This diploma thesis deals with the topic of reconciliation of professional and family life (work-life balance). The topic of harmonization of work and personal life is not new, as every employee had to and has to deal with it to some extent. However it has only become a frequent subject of discussion in recent decades. The times are changing, new technologies are emerging and employees and employers are expecting more and more flexibility from each other. For employees, the issue of work-life balance is thus becoming more and more complex as the line between these two essential spheres of life is becoming more blurred. This thesis focuses on the different legal institutes that are supposed to help better reconcile employees' professional and family life. The first part of this thesis introduces the reader to the whole issue of work-life balance, provides a brief insight into the history of this topic, and draws attention to the unequal position of men and women in this context. The first chapter also sets out the legal framework for reconciliation at the international, European, and national levels. The following chapters of the thesis are devoted to the specific legal regulation in the Czech Republic. The basic premise of work-family harmonisation...

The work is divided into four main chapters, which logically follow each other. The first chapter is devoted to the periodization of history, i.e., the historical context, passed legislation, and attitudes to people with disabilities. This chapter is essential for understanding contexts. The second chapter regulates concepts' coherence and defines basic concepts, such as - a person with a disability, social security or integration, inclusion, and barriers. Cermanová, Valerie ; Štangová, Věra (advisor) ; Lang, Roman (referee)
Sickness insurace benefits provided during pregnancy and maternity The diploma thesis analyses the sickness insurance benefits provided during pregnancy and maternity. The period of pregnancy and maternity is very demanding for a woman both economically, psychologically and physically. Social security law regulates material security to help mitigate in particular the economic impact of these social events. It is an important tool for encouraging an increase in the birth rate and thus has positive effects not only for the individuals directly concerned but for society as a whole. The thesis is composed of an introduction, a core, which consists of five parts, and a conclusion. The first part deals with the basics of social security and the most important moments of its history in relation to the topic of the thesis. The second part focuses on labour protection of women during pregnancy and maternity, which complements the material security regulated by social security law. The third part focuses on general issues of sickness insurance, including participation in sickness insurance, entitlement to benefits, its organisation, management and financing. The fourth chapter is devoted to individual sickness insurance benefits that are directly related to pregnancy and maternity. These benefits are...
