Liability for environmental administrative offenses Abstract The subject of this diploma thesis is the institute of liability for environmental administrative offenses, which consists of two separate legal branches, namely environmental law and administrative law, which intertwine and form a comprehensive system of environmental protection and its components. The mechanisms of this protection include, in particular, prohibitions and orders for certain conduct, various forms of preventive action and, in particular, instruments of a sanction character. The concept of legal liability, which occurs in several types, is associated with sanction instruments, while in the protection of the environment the most widespread legal liability is tort legal liability, specifically administrative offence liability. This issue is still very topical, as on 1. July 2017 there was a new legal regulation of this type of liability and the anchoring of important institutes, which have so far been inferred only by analogy of law and court case law. Legal Protection of Wolf in Czech Republic

The purpose of this diploma thesis is to evaluate legal protection of grey wolf in the Czech Republic based on comparison carried out with legal codes of our neighbours and international law environment in order to offer a solution for revealed deficiencies, since, as the thesis describes, the number of wolfs dwelling in the wild areas of the country has been gradually growing. It is the question of direct protection and wolf's legal status, which is examined, as well as related administrative obstacles, and conditions or means of hunting, respectively. The thesis also deals with the issue of legal status of "wolf-dog" hybrids. Furthermore, currently pressing matter of compensating damage caused by wolfs is examined. Finally, attention is devoted to the protection provided to wolfs within the field of pet breeding and animal trade.

The " Legislation for breeding animals" thesis gives overview of laws and regulations in this area. The respective legislation is included in many acts and regulations of public law, mainly the laws protecting animals from abuse. Some aspects of entrepreneurship and animal trade are included in private law. One part of the thesis covers international agreements and European legislation. Out of secondary European legislation the thesis discusses some regulations relating to the topic. The thesis also contains chapters on legislature concerning animal abuse, veterinary care and animal trade. It states differences in record keeping of farm animals and pet animals. The thesis also deals with animal trade, farming, breeding facilities and animal shelters. The thesis contains a chapter on competencies and the distribution of competencies among the authorities. There is a list of some competencies relating to the topic at every authority, with some authorities there are issues which are rarely addressed in publications (e.g. animal training licence or alternative dispute resolution for consumer disputes). The Constitutional Court as a negative legislator: Restriction of constitutionally guaranteed rights for the purposes of environmental protection Abstract This thesis examines how the Czech Constitutional Court deals with proposals to repeal laws or statutory provisions that restrict constitutional rights or other constitutional provisions concerning environmental protection. Specifically, it examines how the Court deals with conflicts between constitutional rights concerning environmental protection and other constitutional laws pertaining to the environment and/or the public interest in protecting the environment. In addition to the analysis of the decision-making practice of the Constitutional Court, the thesis deals with the anchoring of environmental protection in constitutional documents and in the Czech Constitution - both in the preambls of the Constitution and the Charter, where the environmental protection is embodied in individual rights and the state's duty to protect the environment, including those provisions where environmental or nature protection is explicitly enshrined as a possible grounds for restriction of another constitutional right. Legal Framework of Conditions for Game Hunting The aim of this rigorosum thesis is to describe and compare the legal regulation of game hunting conditions in the Czech Republic. It focuses especially on the legal regulation of the conditions for game hunting according to the Hunting Act and the legal regulation of the conditions for fishing according to the Fisheries Act. Generally, the thesis also analyses the common terms related to fishing and game hunting (eg. the terms fishing district or hunting ground). The attention is paid not only to the current legislation, but the work also covers the historical development of the legal regulation of conditions for game hunting and fishing. Hunting has been accompanying humans since time immemorial and its conditions have evolved over time as society has evolved. This thesis also deals with the rules of game hunting contained in the Act on the Protection of Animals against Cruelty and in the Act on the Protection of Nature and the Landscape. Environmental protection against the harmful effects of human medicinal products Abstract Medicinal products help humanity, but can they be a risk for it? In recent years, the occurrence of their residues in the environment and their impact on it has been monitored. Their occurrence is found to be widespread. Despite the small concentrations in which they occur, they have been shown to affect, for example, aquatic organisms. The issue of residues of medicinal products in the environment is a current topic, beginning to be also addressed by the European Union. The diploma thesis presents the legal regulations of environmental protection against the adverse effects of human medicinal products; it evaluates their effectiveness and, contains proposals de lege ferenda. First, it outlines the issue and the extent of the occurrence of residues of medicinal products in the environment and their risks for it. Furthermore, the work deals with the legal process of registration of medicinal products regulated by European Union law, within which an environmental risk assessment is created. National parks legislation of Czech Republic, Slovakia and USA Abstract The thesis offers a look at the legal regulation of national parks in the Czech Republic, Slovakia and the USA. The diploma thesis points out the legal instruments used for nature protection, especially in the Czech Republic and Slovakia. It gives a picture of common as well as different ways, which were often inspired by each other in the creation of means of nature protection. The work is also focused on amendments to nature protection legislation and their gradual development over time. The content of the work is processed by a descriptive method combining legal regulations of different states. Formally divided into ten chapters. The first chapter offers a historical excursion into the development of nature protection with the first introduction of unregulated efforts by individuals or smaller groups to create specially protected areas. Public participation in environmental decision-making processes Abstract The main goal of this dissertation is to analyse the current legal regulation of public participation in environmental decision-making processes and on the basis of such findings to contribute to the further development of this institute. Public participation in decision-making processes is an important tool for environmental protection, whether we look at it from the point of view of everyone's right to a favourable environment or as a separate value that needs to be protected for itself. It is a relatively new institute in the Czech legal system. Its gradual incorporation into Czech legislation has only occurred in the last 30 years, especially in connection with the Czech Republic's accession to the Aarhus Convention and the European Union. Despite its recognition at the international level, obligations arising for the Czech Republic from the Aarhus Convention and EU law and a number of benefits that come with it, the possibilities of the members of the public in the Czech Republic to participate in environmental decision-making has been significantly reduced in recent years. Criminal Law Instruments of Environmental Protection The dissertation deals with the possibilities of criminal law in relation to the protection of the environment. It presents the analysis of the most significant instruments of criminal law from the sphere of the international, European and Czech law, particularly the Rome Statute of the International Criminal Court, the Directive 2008/99/EC of the European Parliament and of the Council of 19 November 2008 on the protection of the environment through criminal law, and the Czech Criminal Code (Act No 40/2009 Coll.) Apart from the analysis of the most important legal norms and the subsequent formation of proposals de lege ferenda, the dissertation is concerned with the characteristics of environmental crime and the specifics of criminal law in environmental protection. The dissertation is divided into five chapters. The first chapter deals with the issue of the role of criminal law in environmental protection and the peculiarities of creation criminal rules in this area. National parks in the Czech Republic and their legal regulation Abstract The subject of this master theses are national parks in the Czech Republic and their legal regulation. The main legal document that regulates the issue of national parks in our country, is the Act No. 114/1992 Coll., On Nature and Landscape Protection, as amended. This Act has been significantly amended and its wording has been in force since 2017. For the most part, this new regulation affected especially national parks that represent the most important and strictly protected areas in the Czech Republic. Although, in practice the amendment has not yet been fully reflected, as some institutes are still in the process of negotiation or approval. The aim of this thesis is therefore by means of methods of description, analysis and comparison comprehensively summarize regulation of the existing national parks and at the same time in the light of the previous legislation to compare it and analyze. Subsequently, critically evaluate the extent to which the Czech legislator has managed to create an effective legal regulation responding to the current needs of nature protection.
