Diplomová práce se zabývá analýzou dopadů rozdílného přístupu ke kulturní činnosti uskutečňované orchestry založenými mimo rámec podnikání a orchestry založenými za účelem dosahování zisku v oblasti daně z přidané hodnoty. Analýza je uskutečněna komparací pravidel zákona o dani z přidané hodnoty pro obě skupiny orchestrů a jejich simulací na příkladu fiktivního orchestru, která však vychází z dat skutečného tuzemského profesionálního hudebního tělesa založeného mimo rámec podnikání. Z provedené analýzy vyplývá, že v případě velkých orchestrů založených mimo rámec podnikání, které uskutečňují rozmanitou škálu činností, může být režim osvobození kulturních služeb bez nároku na odpočet daně nevýhodný a administrativně náročnější, než pro velké orchestry založené za účelem dosahování zisku. Posouzení vlivu rozdílného přístupu pravidel DPH na činnost orchestrů je poté uvedeno v poslední části práce. This thesis analyzes the different VAT measures applied to non-profit orchestras and orchestras established as business. The analysis is based on the comparison of the rules of the Czech VAT legislation for both types of orchestras and their simulation on the example of a fictional orchestra. However, the simulation is based on data from one of domestic professional non-profit orchestra. The analysis shows that the exemption of cultural services can be unfavorable for large non-profit orchestras carrying out a diverse range of activities. The consequences following the application of different VAT measures are stated in the last part of the thesis.
