106 Pozůstalostní řízení v České republice a v Rakousku Abstrakt Tato rigorózní práce s názvem "Pozůstalostní řízení v České republice a v Rakousku" se zaměřuje na analýzu právní úpravy pozůstalostního řízení v obou zmiňovaných zemích a také na jejich komparaci. Cílem této práce není detailní popis všech institutů týkajících se pozůstalostního řízení, nýbrž zpracování uceleného přehledu průběhu řízení v obou zemích. Dále se tato práce zaměřuje na poukázání na problémy vyskytující se v notářské praxi v souvislosti s pozůstalostním řízením, které přináší v některých ohledech nejasná právní úprava a také určité změny a novoty ve společnosti, které se projevují také v soudních řízeních. Součástí této práce je také navržení možných legislativních řešení zmiňovaných problémů. Samotná práce se člení na tři hlavní části, a to Pozůstalostní řízení v České republice, Pozůstalostní řízení v Rakousku a srovnání pozůstalostního řízení v České republice a v Rakousku. První část této práce se zaměřuje na historický vývoj notářství na našem území, jeho aktuální stav a také právní úprava. Následně je popsáno pozůstalostní řízení v obecné rovině, včetně zásad v něm uplatňovaných, jeho účastníků a také insitutu soudního komisaritátu. V této části je také analyzována aktuálně platná právní úprava týkající se pozůstalostního... 108 Inheritance proceedings in the Czech Republic and Austria Abstract This rigorous thesis entitled "Inheritance proceedings in the Czech Republic and Austria" focuses on the analysis of legal regulation of probate in both mentioned countries and also on their comparison. The aim of this work is not a detailed description of all institutes related to probate, but rather a comprehensive overview of the proceedings in both countries. Furthermore, this thesis focuses on pointing out the problems occurring in notary practice in connection with inheritance proceedings, which in some respects are brought about by unclear legal regulation as well as certain changes and news in society, which are also manifested in court proceedings. Part of this thesis is also the proposal of possible legislative solutions to the mentioned problems. The work itself is divided into three main parts, namely Inheritance proceedings in the Czech Republic, Inheritance proceedings in Austria and a Comparison of probate proceedings in the Czech Republicand in Austria. The first part of this thesis focuses on the historical development of notaries in our country, its current status and legal regulation.
