Co to jsou náhražky tuzemských peněz a jaký je jejich právní režim? Abstrakt Práce pojednává o postavení náhražek tuzemských peněz v českém právním řádu a fenoménu náhražek státních peněz obecně. Práce se dělí na tři části, v první autor analyzuje současnou právní úpravu náhražek tuzemských peněz v českém právním řádu, přičemž dochází k závěru, že současná úprava je zjevně obsoletní, přičemž její výklad moderní právní vědou autor považuje nejen za restriktivní, ale také za velmi formalistický, a tedy zcela neplnící její zákonodárcem stanovenou roli. V závěru první části autor dochází k závěru, že některé vybrané formy nestátních peněz (především firemní peníze a LETS systémy) sice odpovídají současnému pojetí náhražek tuzemských peněz, ovšem nelze je považovat za součást moderní ekonomické reality. V druhé části pak autor analyzuje moderní podoby nestátních peněz se zaměřením na kryptoměny, coby nejrelevantnější formu nestátních peněz. Autor popisuje postupný vývoj a akceptaci virtuálních měn jak z pohledu evropských regulačních orgánů, tak z pohledu jejich reálného ekonomického využití. Autor dochází k závěru, že značná část virtuálních měn spadá do původního vymezení náhražek tuzemských peněz a neuplatňování § 239 odst. 1 Trestního zákoníku tedy pouze potvrzuje závěry první části práce. Abstract The thesis deals with the position of substitutes for domestic money in the Czech legal system and the phenomenon of substitutes for state money in general. The work is divided into three parts, in the first the author analyzes the current legal regulation of domestic money substitutes in the Czech legal system, concluding that the current regulation is clearly obsolete, while its interpretation by modern legal science is considered not only restrictive but also very formalistic, and thus not completely fulfilling the role set desired by original legislator. At the end of the first part, the author concludes that some selected forms of non-state money (especially corporate money and LETS systems) correspond to the current concept of substitutes for domestic money, but they can not be considered part of modern economic reality. In the second part, the author analyzes modern forms of non-state money with a focus on cryptocurrencies, as the most relevant form of non-state money. The author describes the gradual development and acceptance of virtual currencies both from the perspective of European regulators and from the perspective of their real economic use.
