Bakalářská práce představuje úpravu osobnostních práv v historicky prvním občanském zákoníku ČLR 中华人民共和国民法典. Ta byla dosud upravena napříč několika normami. V tomto ohledu je kodifikace významným právním počinem. Práce se snaží nalézt odpověď na otázku, zda občanský zákoník nabízí větší míru ochrany než předchozí úprava, a do jaké míry je tato ochrana vymahatelná. Po úvodních kapitolách, které zasazují některá klíčová slova do kontextu, je většina práce věnována srovnání staré a nové úpravy. Práce dospívá k závěru, že byť se zákoníku podařilo do úpravy vnést řadu nových, a kontinentální právní úpravě známých institutů, v řadě oblastí zákoník původní nedostatky neodstranil; na jiných místech pak dokonce do úpravy vnáší nová kontroverzní ustanovení, která jsou v některých případech napojena na konkrétní mocenské zájmy KS Číny. Powered by TCPDF (www.tcpdf.org) This bachelor thesis presents the regulation of personality rights in the first ever Civil Code of the PRC 中华人民共和国民法典. Prior to the promulgation of the Civil Code personality rights had been scattered across various legal norms. In this respect, the codification is a significant legal achievement. This thesis seeks to answer the question of whether the Civil Code offers a greater degree of protection than the previous regulation, and to what extent is this protection enforceable. Following a few introductory chapters, which put some key words in context, most of the thesis is devoted to a comparison of the old and new regulation. The thesis concludes that although the Code has succeeded in introducing several new institutes also familiar to the continental law doctrine, in a number of areas the Code has not remedied the deficiencies of the original regulation; in other places, it even introduces new controversial provisions, which in some cases are linked to specific power interests of the CCP.
