Lidská práva osob se zdravotním postižením Práce se zabývá aktuálním vývojem lidských práv osob se zdravotním postižením z perspektivy ústavního práva. Práce nejprve mapuje historické proměny právního postavení osob se zdravotním postižením - od starověku až po neblahé zkušenosti s popíráním lidské důstojnosti v první polovině 20. století. Dále práce ukazuje, jakým vývojem prošla lidská práva osob se zdravotním postižením ve druhé polovině 20. století. Klíčovým hybatelem tohoto procesu je hodnota lidské důstojnosti, která se po přijetí Všeobecné deklarace lidských práv stává hlavním východiskem pro ochranu lidských práv nejen osob se zdravotním postižením. Proměny pojetí lidských práv osob se zdravotním postižením souvisí s posunem od lékařského k sociálnímu konceptu zdravotního postižení, na jehož základě vznikla v roce 2006 Úmluva OSN o právech osob se zdravotním postižením (CRPD). Tato úmluva ztělesňuje nový přístup k lidským právům osob se zdravotním postižením, které již nemají být pouze předmětem charity a sociálního zabezpečení, ale především rovnoprávnými subjekty práva a plnohodnotnými členy společnosti. Česká republika je smluvní stranou CRPD a je jí vázána, závazky pramenící z CRPD postupně pronikají do českého ústavního práva, a to různými mechanismy, které práce podrobně popisuje.... Human Rights of Persons with Disabilities The thesis deals with the current development of human rights of persons with disabilities from the perspective of constitutional law. The work first maps the historical changes of the legal status of persons with disabilities - from antiquity to the tragic experience of denying human dignity in the first half of the 20th century. Furthermore, the thesis shows the development of the human rights of persons with disabilities in the second half of the 20th century. A key driver of this process is the value of human dignity, which, following the adoption of the Universal Declaration of Human Rights, has become the main starting point for the protection of human rights (not only) persons with disabilities. The changes in the concept of human rights of people with disabilities are related to the shift from the medical to the social concept of disability, on the basis of which the UN Convention on the Rights of Persons with Disabilities (CRPD) was adopted in 2006. This convention embodies a new approach to human rights of persons with disabilities, who should no longer be subject only to charity and social security regulations, but above all they should be recognized as they are - as an equal legal subjects and full members of the society.
