Práva dítěte v mezinárodních dokumentech v oblasti soudnictví ve věcech mládeže Abstrakt Děti v konfliktu se zákonem patří mezi zvláště zranitelné skupiny osob. Jejich zranitelnost v tomto případě vyplývá z kombinací faktorů. Z jedné strany je zranitelnost dítěte dána jeho častou závislostí na dospělých osobách a jeho specifickým postavením dítěte, na druhé straně je pro práva dítěte riziková rovněž samotná situace, kdy se dítě dostává do styku se systém trestního soudnictví. I v těchto situacích je však dítě stále plnohodnotným nositelem práv a může se těchto práv a jejich ochrany dožadovat. Každý stát by měl proto zajistit odpovídající ochranu delikventním dětem a dbát tak svých mezinárodních závazků. Na půdě Organizace spojených národů vzniklo mnoho dokumentů závazných i doporučujících, které společně vytváří mezinárodněprávní standardy a normy soudnictví ve věcech dítěte. Za nejvýznamnější dokument je považována Úmluva o právech dítěte z roku 1989, která letos slaví 30 let od svého přijetí. Pro tuto práci mají význam zejména čtyři obecné principy Úmluvy o právech dítěte společně se zvláštními principy pro oblast trestního systému soudnictví dětí zakotvenými v článku 40 a článku 47. Upholding the International Rights of Children in Conflict with the law Abstract Children in conflict with the law are a particularly vulnerable group. This vulnerability results from their specific status as children as well as their contact with the justice system. Generally, children are vulnerable due to their frequent dependence on adults and societal views that children are subordinate to them. When children, who are already vulnerable due their status, come into contact with the criminal justice system, their rights are at further risk for violation. However, even in these situations, the child is still a fully-fledged bearer of his or her rights and can claim protection and fulfillment thereof. Therefore, each state should ensure adequate protection for children in conflict with the law thus respecting its obligations stipulated in international law. Many binding and non-binding documents were adopted by various bodies within the United Nations (UN). Taken together, these documents form the international legal standards and norms on which the international juvenile justice framework is based.
