Čas plnění dluhu (se zaměřením na zvláštnosti závazků podnikatele) Abstrakt Práce se zabývá časem plnění dluhu z pohledu soukromého práva, a to se zaměřením na zvláštnosti závazků podnikatele. Cílem práce je toto téma komplexně popsat a analyzovat. Čas plnění dluhu je analyzován především z funkčního hlediska a je zdůrazněna jeho návaznost na další právní instituty. Práce je rozdělena do pěti kapitol, které postupují od obecného ke zvláštnímu. V první kapitole je podán obecný úvod k tématu. Čas plnění dluhu je zasazen do systému závazkového práva a jsou analyzovány jeho funkce. Na to navazuje komparativní exkurz do předpokladů nastoupení následků porušení závazku, ze kterého se dále v práci vychází. Pozornost je dále věnována terminologii (čas plnění, splatnost, splnitelnost) a významu času a jeho podobám v právu. Ve druhé kapitole jsou analyzovány případy, kdy je čas plnění předem určen (§ 1958 odst. 1 OZ) a jsou přiblíženy jednotlivé právní důvody, které mohou čas plnění určit. Třetí kapitola se věnuje případům, kdy čas plnění není předem určen a je buď 1) na vůli věřitele (§ 1958 odst. 2 OZ), anebo 2) na vůli dlužníka (§ 1960 OZ). Druhá a třetí kapitola obsahují stěžejní výklad pozitivního úpravy času plnění dluhu. Ve čtvrté kapitole je analyzována otázka předčasného plnění. Ve všech těchto kapitolách je... Time of Performance of an Obligation (Focusing on Entrepreneurs' Obligations) Abstract The thesis deals with time of performance of an obligation from the perspective of private law and focuses on entrepreneurs' obligations. The aim of the thesis is to provide a comprehensive description and analysis of the topic. Time of performance is analysed while employing functional approach and its relationship with other legal institutes is emphasized. The thesis is divided into five chapters. It starts with general subjects and ends with the special ones. The first chapter provides a general introduction to the topic. Time of performance is classified within the law of obligations and its functions are analysed. Then there is a comparative excursus, which is made use of later in the thesis, that focuses on prerequisites of remedies for non-performance. The thesis then focuses on terminology (time of performance, maturity, ability to perform) and on the concept of time in the field of law. In the second chapter, cases where time of performance is determined in advance (Section 1958 para. 2 CC) are analysed and particular sources of time of performance are illuminated.
