[cze][eng] Cílem této práce je analýza dopadu digitálních platforem na pracovní právo a na podobu práce obecně. Těžištěm práce je zvolen popis způsobovaných problémů a jejich možná řešení, přičemž hlavní pozornost je věnována problematickému postavení pracovníka v ekonomice platforem a jeho možnými úpravami. V úvodu se tato práce nejprve zabývá obecnou charakteristikou digitálních platforem a jejich tříděním do tří pomyslných kategorií (crowdsourcing, on demand work a přepravní platformy). Pro lepší porozumění pracovních podmínek následně přibližuje jednotlivé fáze práce, ke kterým skrze zprostředkování platforem dochází. Po těchto uvádějících kapitolách začíná práce již věnovat pozornost potenciálním problémům. Možné problémy jsou nejprve popsány obecně a následně dochází k analýze praktických problémů, jimiž se již zabývala judikatura. Analýza judikatury je rozsáhlejší, neboť tři vybraná rozhodnutí se povšechně zabývají digitálními platformami a mimo možná řešení problémů nabízejí také pohled na konkrétní obchodní modely jednotlivých platforem. Po rozboru judikatury, která v této otázce předběhla legislativu, dochází i k její analýze. Nejprve je tedy rozebírán právní rámec Evropské Unie a některých členských států, kde je podrobněji rozebrán institut příležitostné práce, jenž vykazuje některé shodné znaky s...This thesis provides an analysis of digital platforms and its impact on labour law and related work patterns in general. The main focus is upon description of caused problems and their possible solutions whereas the question of worker's status in the platform economy and its arrangements is predominantly discussed. The introduction leads the reader to general description of digital platforms and its three main subsets (crowdsourcing, on deman work and passenger transport services). For a better undestanding the thesis further gives an idea of working conditions by analysing each working stage affected by platforms. After these initial introductory findings the thesis focuses on potential problems. The possible problems are first being described in general and then discussed from the practical point of view as they were already seen by various courts in the past. The sole analysis of courts decision is rather extensive since the three chosen decisions not only give us answers to some problematic questions but they also provide highly beneficial info about platforms in general and their business models as well.
