Vztah známkoprávní a autorskoprávní ochrany Abstrakt Tématem této práce je vztah ochrany známkoprávní a autorskoprávní. Cílem práce bylo přiblížit oblast ochranných známek a autorských práv, popsat jejich vzájemný vztah a zaměřit se na aspekty, ve kterých se obě tyto ochrany významně liší. Práce se podrobněji zaměřuje na ochranné známky, kterým se věnuje vždy v úvodu každé kapitoly a následně je srovnává s autorským právem. První čtyři kapitoly práce se se zabývají klíčovými oblastmi obou ochran, zejména představením hlavních institutů a jejich účelu, systematizací ochranných známek a autorských děl, vznikem, trváním a zánikem obou ochran, subjektivními právy a v neposlední řadě výlukami ze známkoprávní a autorskoprávní ochrany. Pátá kapitola se zaobírá vztahem obou ochran a popisuje vzájemné rozdíly, které se vyskytují zejména ve vzniku, trvání, formě a rozsahu právní ochrany. Dále rozebírá možnost vzniku souběhu obou ochran, jeho příčiny, druhy a důsledky. Výstupem práce je přehled známkoprávní a autorskoprávní ochrany a rozebrání jejich vzájemného vztahu s důrazem na přiblížení společných znaků a odlišností a využitelnost v praxi. Závěr této práce shrnuje důležitost obou ochran a nemožnosti porovnávání jejich vzájemné síly, která pramení z odlišného účelu každé ochrany. Rozebírá možný souběh obou ochran,... The relationship between trademark protection and copyright protection Abstract The theme of this thesis is the relationship between trademark and copyright protection. The aim of the thesis was to describe the area of trademarks and copyrights, to describe their mutual relationship and to focus on aspects where both of these protections differ significantly. The thesis focuses in more detail on trademarks, which is always addressed at the beginning of each chapter and then compares them with copyright. The first four chapters deal with the key areas of both protections, especially the introduction of the main institutes and their purpose, the systematization of trademarks and copyrights, the origin, duration and termination of both protections, subjective rights and as last but not least exclusions from trademark and copyright protection. The fifth chapter deals with the relationship of both protections and describes the mutual differences that occur especially in the origin, duration, form, and scope of legal protection. It also discusses the possibility of the concurrence of both protections, its causes, types, and consequences.
