102 Abstrakt Předkládaná diplomová práce se zabývá vývojem práva myslivosti od 2. poloviny 18. století. V první části diplomové práce však je, tak aby byl poskytnut kontinuální pohled na danou problematiku, přistoupeno ke shrnutí právního vývoje myslivosti před rokem 1754, a to včetně těch nejstarších právních pramenů, jakým je honební regál Boleslava I. a jiné. Nebylo opomenuto období třicetileté války, během kterého docházelo k razantnímu snižování stavů zvěře, a proto bylo přistoupeno k přijetí mysliveckého řádu Ferdinanda III. ze 14. prosince 1641, který zakázal lov po následující tři léta a zavedl mnoho ochranných opatření. Tato část diplomové práce ukázala, jak se obsah myslivosti v průběhu doby měnil. Myslivost byla nejdříve chápána jako výsadní právo panovníka, později šlechty. Až v pozdějších dobách byl myslivostí chápán i chov a ochrana zvěře. Nosná část diplomové práce se zabývá moderními právními předpisy. Nejprve je představena právní úprava myslivosti z období vlády císařovny Marie Terezie a jejího syna Josefa II. V tomto období byla myslivost podřízena hospodářským potřebám monarchie a bylo přistoupeno k razantnímu snižování stavů zvěře. Následně je pozornost věnována patentu č. 154 císaře Františka Josefa I. ze dne 7. března 1849, kterým bylo zrušeno právo myslivosti na cizí půdě. Obsahem... 103 Summary This diploma thesis is focused on development of the game keeping law from the second half of the eighteenth century till the twentieth century. In the first part of the thesis, in order to provide a comprehensive view on the given issue, a summary of legal development of game keeping law before the year 1754 is outlined, including the oldest legal sources, beginning with "honební regál" issued by Boleslav I. and others. The period of the Thirty Years' War, during which a large downsizing of game ocurred, consequently servingas a basis for "Hunting order" issued by Ferdinand III. on 14th December 1641, prohibiting hunting for three following years and implementing a lot of protective measures, was not omitted. That part of this thesis demonstrates how the contents of gaming is subject to changes over time. At first, gaming was viewed as a sovereign's privilege, afterwards also aristocracy got to enjoy it. Later on, gaming began to include breeding and protection of game itself as well. The major part of the thesis is dedicated to modern laws. Firstly, game keeping law from the government period of Marie Therese and her son Joseph II. is introduced.
