Nadměrné využívání živé přírody je druhou nejčastější příčinou ubývání druhů na naší planetě, a tedy jednou z přímých hrozeb pro biologickou rozmanitost. Jelikož biologická rozmanitost má pro člověka doslova existenční význam, je třeba o ni pečovat a snažit se alespoň zpomalit její pokles. Cílem této práce je analyzovat a zhodnotit právní úpravu na mezinárodní, unijní a české úrovni, představit instrumenty a instituty, jichž k regulaci obchodování s exempláři CITES využívá, a navrhnout řešení případných problematických míst. Tam, kde je to nezbytné či vhodné, je provedena komparace mezinárodní právní úpravy na jedné straně a unijní a české právní úpravy na straně druhé. Práce je rozdělena do 6 kapitol, které jsou dále vnitřně členěny. První kapitola se zabývá významem obchodu s ohroženými druhy fauny a flóry pro pokles biodiverzity a charakterizuje jej. Druhá kapitola podává přehled právní úpravy regulující obchod s exempláři, a to po jednotlivých úrovních (mezinárodní, unijní a česká). Ve třetí kapitole jsou představeny jednotlivé orgány zabezpečující provádění Úmluvy CITES (resp. nařízení č. 338/97) na mezinárodní, unijní a české úrovni. České vnitrostátní orgány jsou rozděleny podle systematiky zákona č. 100/2004 Sb. na orgány státní správy a vědecký orgán. Čtvrtá kapitola slouží jako vstupní... Excessive usage of wildlife is the second most common cause of species decline on our planet, and thus one of the direct threats to biodiversity. Since biodiversity has a virtually existential significance for the well-being of people, it needs to be cared for in order to slow down its decline. The aim of this thesis is to analyze and evaluate legal regulations at the international, EU, and Czech level, to present the instruments and institutes used to regulate the trade in CITES specimens, and to propose solutions for potential problems. Where deemed necessary or appropriate, a comparison of international legal regulations with EU and Czech legislation is made. This thesis is divided into 6 chapters that are further internally subdivided into subchapters. The first chapter deals with the importance of trade in endangered species of fauna and flora in relation to the loss of biodiversity. The second chapter provides an overview of the legal regulation governing trade in endangered species at different levels (international, EU, and Czech). The third chapter introduces the individual bodies responsible for the implementation of the Convention CITES (or Regulation No. 338/97) at international, EU, and Czech level.
