Soutěžněprávní aspekty technické standardizace, užívání a ochrany práv duševního vlastnictví Abstrakt Předkládaná práce se zabývá vzájemným vztahem práva duševního vlastnictví a soutěžního práva v kontextu technické standardizace - tj. procesu, který představuje významné ohnisko potencionálních střetů těchto dvou právních odvětví. Na pozadí technické standardizace je analyzováno, jakým způsobem soutěžněprávní regulace ovlivňuje výkon subjektivních práv vlastníků duševního vlastnictví, přičemž cílem této diplomové práce je posoudit, zda právní úprava, ze které tato regulace vyplývá, vykazuje potřebnou míru právní jistoty a zda se uplatní bez rozdílu na všechny typy tržních subjektů, nebo jestli ve vztahu k některým z nich vykazuje určité odchylky. Pozornost je zejména věnována soutěžněprávním aspektům samotného vzniku technických standardů v prostředí informačních a komunikačních technologií a vybraným rizikům spojeným s užíváním či ochranou práv duševního vlastnictví ve vztahu k čl. 101 a čl. 102 SFEU. První kapitola obecně vymezuje pojem technického standardu, představuje rozlišení mezi de facto a de iure standardy, popisuje způsob jejich vzniku a analyzuje možné dopady procesu technické standardizace na hospodářskou soutěž, zejm. s ohledem na čl. 101 SFEU. Competition law aspects of technical standardization, use and protection of intellectual property rights Abstract The thesis deals with mutual relationship between intellectual property law and competition law in the context of technical standardization - i.e. process which gives rise to a significant number of potential conflicts between the two legal areas. It is analysed, in the context of technical standardization, in what way are subjective rights of intellectual property right owners limited by competition law regulation. It falls within the ambit of this thesis to evaluate whether respective legal framework fulfils necessary requirements on legal certainty and whether it is applied in the same manner to each undertaking, or if there are any discrepancies as to the application of the legal framework dependent on the kind of the undertaking. This thesis particularly concerns with competition law aspects of standardization in information and communication technology sector and selected issues related to use or protection of intellectual property rights in connection to article 101 and 102 TFEU.
