Právní úprava ochrany želv Abstrakt Práce se zabývá právní úpravou ochrany želv v pramenech mezinárodního práva, českou právní úpravou chovu želv v zajetí a právní úpravou ochrany biodiverzity před želvami jako nepůvodními či invazními druhy. Cílem práce je popsat a analyzovat právní úpravu ochrany želv a v případě závěru, že je úprava v některých oblastech nedostatečná, učinit návrhy de lege ferenda. Dalším cílem je popsat právní úpravu ochrany biodiverzity v situaci, kdy je některý druh želv v postavení nepůvodního, popř. invazního druhu. První část obsahuje věcný úvod do problematiky. Je zde uvedeno biologické zařazení želv, význam želv pro ekosystém a zdroje ohrožení. Druhá část se zabývá právní úpravou ochrany želv v obecných úmluvách na ochranu přírody - globálních i regionálních. V první kapitole jsou uvedeny globální úmluvy, které jsou dále rozděleny na Úmluvu o biologické rozmanitosti, úmluvy na ochranu stanovišť a úmluvy s druhovým předmětem ochrany. V druhé kapitole jsou uvedeny regionální "pevninské" úmluvy. Třetí část se věnuje specifikům právní úpravy ochrany mořských želv. Nejprve jsou rozebrána relevantní ustanovení UNCLOS, poté prameny práva, v nichž jsou želvy v postavení migrujících druhů a specifika CITES pro mořské želvy. Také je k ochraně mořských želv jako druhů ohrožených... Turtle and Tortoise Protection Legislation Abstract The thesis focuses on turtle and tortoise protection in international law, Czech legislation on breeding turtles in captivity, and legislation concerning protection of biodiversity against turtles as alien or invasive species. The objective is to describe and analyse turtle protection legislation and if concluded that the legislation is not sufficient, make proposals de lege ferenda. Another objective is to describe biodiversity protection legislation in a situation when a turtle species is in a position of alien or invasive species. The first part contains introduction to the matter considered. It includes biological classification, the importance of turtles for ecosystems, with special focus on sea turtles, and threats to turtles, again with special focus on sea turtles. The second part focuses on turtle protection in general agreements on nature protection - global and regional. In the first chapter, there are global agreements which are then divided to The Convention on Biological Diversity, agreements on protections of habitat, and agreements on species protection. In the second chapter, there are regional "land" agreements listed. The third part concentrates on specifics of sea turtle legislation. At first, relevant parts of UNCLOS are mentioned....
