i Název diplomové práce v českém jazyce Smlouva o péči o zdraví podle NOZ Abstrakt Diplomová práce pojednává o smlouvě o péči o zdraví podle NOZ. Smlouva o péči o zdraví se účinností občanského zákoníku 89/2012 Sb. stala 1. 1. 2014 novým pojmenovaným smluvním typem. Vzhledem k důležitosti a širokému využití smlouvy o péči o zdraví je až zarážející, jak nízké veřejné povědomí o existenci takového smluvního vztahu mezi širokou veřejností panuje. Práce si klade za cíl dané téma obecně představit, rozebrat jeho jednotlivé části a ty dále analyzovat. Zároveň práce upozorní na výkladové problémy či legislativní přešlapy a nejasnosti. Teoretická stránka práce je vhodně doplňována praktickými příklady, které přispívají ke srozumitelnosti výkladu a pochopení smluvního vztahu v jeho celistvosti. Dále je v práci nastíněn vztah občanského zákoníku a zvláštní úpravy. Nechybí historický podtext a základní mezinárodněprávní úpravy péče o zdraví. Institut souhlasu je navíc rozebrán v rámci zahraničního exkurzu i pohledem anglického práva. Ohledně samotné smlouvy o péči o zdraví zpracovává práce smluvní strany, způsob uzavření smlouvy, její předmět a také možnosti zániku závazku. Větší část práce je však věnována právům a povinnostem smluvních stran, kdy je obdobně jako v občanském zákoníku kladen důraz na institut poučení... i Název diplomové práce v anglickém jazyce Contract for health care under the Civil Code Abstract This master thesis discusses a contract for health care under the Civil Code. A contract for health care was established as a new nominate contract type on the 1st of January 2014, as the Civil Code Act 89/2012 Sb. became effective. Considering the importance and wide use of the contract, it is staggering how the public knowledge about this topic is insufficiently low. The aim of this thesis is to generally introduce the topic and analyse its individual aspects. The thesis also draws attention to potential interpretation issues and legislative imperfections or ambiguities. The theoretical angle is suitably being supported by practical examples, which contribute to the overall understanding of the topic as well as make the explanation clearer. This paper gives an elementary explanation of relations between the Civil Code as a general act and special acts. To provide the best possible picture of the contract type, author likewise mentions a brief historical background and relevant elementary international law relations.
