Osobnostní autorská práva v ČR a vybraných zemích kontinentálního systému a Common Law Abstrakt Tato práce se zaměřuje na osobnostní autorská práva, která spolu s autorskými majetkovými právy tvoří základní rozdělení autorských práv. Osobnostní autorská práva mají primárně chránit osobnostní/nemajetkové zájmy autora. V úvodu této práce jsou vymezena os. aut. práva a jejich historický vznik v rámci tzv. kontinentálního právního systému. Následně je v druhé kapitole uveden rozdíl k přístupu k těmto právům v Kontinentálním systému a systému Common Law včetně historického exkurzu do jednotlivých systémů. Třetí kapitola se stručně zaobírá vývojem autorských práva s důrazem na os. aut. práva, tedy zejména období 18. století, včetně vymezení rozdílů mezi přístupem monistickým a dualistickým a problémů týkající se teritoriality práva. Dále jsou v přehledu uvedeny autorské zákony platné na území ČR ve 20. a částečně i v 19. století. Ve čtvrté kapitole jsou podrobně rozepsána jednotlivá osobnostní autorská práva v platné právní úpravě ČR. Pátá kapitola se zaměřuje na úpravu os. aut. práv v rámci evropského práva, přičemž lze konstatovat, že os. aut. právy se evropské právo zatím nezaobírá. V šesté kapitole jsou uvedeny vybrané mezinárodní úmluvy s důrazem na Revidovanou Bernskou úmluvu, která zakotvila mezinárodní... Moral rights in the Czech Republic and in selected countries of continental and Common Law legal systems Abstract This thesis focuses on moral rights, which together with economic rights form one of basic ways how to divide copyright law. The primary function of moral (copyright) rights is to protect various rights of the author, which are not economic rights. In the introduction part of this thesis there are basic definitions and specifications of moral rights and their genesis in the continental legal system. The second chapter explains the different approach to moral copyright in the continental legal system and in the Common Law legal system, including a short historical excursion into those legal systems. The third chapter is briefly dedicated to the development of copyright law with the emphasis on moral rights during the 18th century, explanation of the difference between one-tier and two-tier approach to copyright law and certain issues regarding the territoriality of law. It also contains relevant legal acts that were in force in the Czech Republic during the 20th and partially during the 19th century. The fourth chapter consists of thorough explanation concerning each type of moral rights in the Copyright act that is currently in force in the Czech Republic.
