Ochrana před průtahy ve správním řízení a v řízení před správními soudy Abstrakt Předmětem této práce je ochrana před průtahy ve správním řízení (kde je právní předpisy označují jako nečinnost) a před správními soudy. Průtah je stav, kdy úkony určitý úkon v řízení z nějakého důvodu není proveden ve lhůtě, ve které by měl být učiněn. Důvody průtahů mohou být různé. Mohou být objektivní, které mohou spočívat v množství věcí, které osoba rozhoduje, ať už je to z důvodu nedostatečného personálního zabezpečení orgánu, před kterým se řízení vede, či z důvodu nedostatků v organizaci práce u tohoto orgánu, nebo mohou spočívat v nutnosti dodržení posloupnosti procesního postupu spočívající v nezbytnosti provést úkon, který danému úkonu předchází. Důvody průtahů mohou být i subjektivní, spočívající v nedostatečné rychlosti práce, ať už je způsobena leností nebo neschopností. Listina základních práv a svobod hovoří o povinnosti projednat věc bez zbytečných průtahů. Tato povinnost se vztahuje jak na správní řízení, tak na řízení před správními soudy. Vzhledem k tomu, že se jedná o právní předpis, který je součástí ústavního pořádku, nemohou podústavní právní normy obsahovat pravidlo, které by bylo se zásadou projednání věci bez zbytečných průtahů v rozporu a veškeré podústavní právní normy se musí v souladu s touto... Protection against delays in administrative proceedings and in proceedings before administrative courts Abstract The subject of this work are delays in administrative proceedings (where its legislation marks them as inaction) and before administrative courts. A delay is a state in which a certain act in the proceedings for some reason is not undertaken at the time within which it should be done. Reasons for delays may vary. They may be objective, which may consist of a number of cases that a person decides, whether it is due to insufficient staffing of the authorities in charge of the proceedings, or because of the deficiencies in the organization of work with that authorities, or may consist in the necessity of following the sequence of a process involving the necessity to perform an act that precedes the given operation. Reasons for delays can also be subjective, due to the lack of speed of work, either due to laziness or incompetence. The Charter of Fundamental Rights and Freedoms speaks of the duty to discuss the matter without unnecessary delays. This obligation applies both to administrative proceedings and to proceedings at the administrative courts.
