212 ABSTRAKT Okolnosti vylučující trestnost 305. Hlavním účelem této práce je analyzovat povahu okolností, které jsou v českém trestním právu normovány, jako okolnosti vylučující protiprávnost. Zaměřuje se přitom na dvě okolnosti, které jak v historickém srovnání, tak v komparaci se úpravami v okolních státech nejsou za všech okolností koncipovány jako tzv. ospravedlnění (okolnost vyluču- jící protiprávnost), ale i jako důvod vyloučení subjektivní trestní odpovědnosti (omluvná okolnost). 306. Při tom jsou nejprve analyzovány pojmy trestnosti, trestní odpovědnosti a proti- právnosti v jejich rozličných pojetích, která lze v teorii trestního práva nalézt. Jsou tak po- stupně vyjasňovány zejména pojmy formální a materiální trestnosti, formální a materiální protiprávnosti, tzv. trestní protiprávnosti a zvláštní protiprávnosti. Výsledkem tohoto zkoumání je závěr, že protiprávnost existuje pouze jediná, kterou se vyjadřuje rozpor z hlediska celého právního řádu. Tento pojem je třeba odlišovat od pojmů trestnosti a trestní odpovědnosti, jejichž je podmínkou. V této obecné části je analyzováno i to, kam v systému znaků trestného činu protiprávnost patří a jaké přitom plní funkce. 307. The main purpose of this thesis is to analyze the nature of the circumstances, which are standardized in Czech criminal law, as circumstances excluding unlawfulness. Main focus is on two of them that, in both historical and international comparison, are not in all circumstances conceived as so-called justification (circumstance excluding unlawful- ness), but also as a reason for excluding subjective criminal liability (excuse). 2. The concepts of criminality, criminal liability and anti-legality in their various con- cepts, which can be found in the theory of criminal law, are first analyzed. Thus, in par- ticular, the concepts of formal and material criminality, formal and material unlawfulness, so-called criminal unlawfulness and special unlawfulness are clarified consecutively. The result of this investigation is the conclusion that unlawfulness is only one and expresses a contradiction with the whole legal order. This concept should be distinguished from the concepts of criminality (as attribute) and criminal liability. Unlawfulness is their condi- tion.
