TY - THES TI - Crimen falsi a příbuzné skutkové podstaty TT - Crimen falsi and related facts of crimes AU - Ullmann, Jan AB - Název práce: Crimen falsi a příbuzné skutkové podstaty Tato práce, jejímž názvem je "Crimen falsi a příbuzné skutkové podstaty", představuje komplexní rozbor vývoje právní úpravy čtyř vzájemně velmi úzce souvisejících zločinů - crimen falsi (zločinu podvodu), crimen repetundarum (zločinu zneužití pravomoci úřední osoby k vlastnímu obohacení), peculatus (zločin krádeže veřejného či posvátného majetku) a stellionatus (zbytková skutková podstata, zahrnující jakékoli další podvodné jednání), tedy tří zločinů veřejnoprávních a jednoho mimořádného, který nelze zařadit ani mezi crimina, ani mezi delicta. Práce začíná rozborem vývoje římského trestního práva v době královské, kde se autor věnuje zkoumání počátků trestního procesu a právní úpravy zločinů, které lze označit za předchůdce uvedených zločinů. V dobách zrodu Římské republiky a vytvoření Zákona dvanácti desek je výzkum počátků zkoumaných zločinů podložen i rozborem záznamů jednotlivých trestních procesů, v nichž byly řešeny zločiny, které později tvořily součást skutkových podstat zkoumaných zločinů. Zásadní část práce tvoří rozbor právní úpravy zkoumaných zločinů v dobách územního a mocenského rozvoje Římské republiky, a to především v prvním století před naším letopočtem, kdy byly v rámci Sullových reforem přijaty zákony, upravující crimen... AB - Thesis title: Crimen falsi and related facts of crimes This thesis with the name "Crimen falsi and related facts of crimes", represents the complex analysis of a development of four mutually very closely interconnected crimes - crimen falsi (the crime of deceit), crimen repetundarum (the crime of abuse of official authority to the personal profit), peculatus (the crime of theft of a public or sacred property) and stellionatus (the residual crime, including any other deceitful act), three public crimes and one extraordinary crime, which can not be classified as crimen, nor as delictus. This thesis starts with the analysis of development of roman criminal law in the age of kings, where the author researches beginnings of the criminal process and the legislation of crimes, which can be described as predecessors of analysed crimes. In the time of the early Roman republic and institutioning of the Law of the twelve tablets is the research of beginnings of analysed crimes supported by the analysis of individual criminal proceedings, within which were judged crimes, which were later parts of factual bases of analysed crimes.
