Kolektivní správa práv autorských a práv souvisejících s právem autorským Resumé Diplomová práce se zabývá institutem kolektivní správy, důvody jejího vzniku a vývoje až po současný právní stav. Cílem této práce je popsat práva a povinnosti kolektivních správců vůči ostatním subjektům a kriticky zhodnotit její fungování s ohledem na názory určité části veřejnosti o jejich nadbytečnosti. V práci je rovněž popsán vliv mezinárodního a evropského práva na podobu správců v právním řádu České republiky. Autor se rovněž věnuje judikatuře jak národních soudů, tak i Soudního dvora Evropské unie. Práce je rozčleněna do sedmi kapitol. V prvních dvou kapitolách je nastíněn vývoj kolektivní správy ve světě a na území České republiky. Ve třetí kapitole je popsána účinná právní úprava kolektivní správy. V rámci této kapitoly autor pojednává o jednotlivých kolektivních správcích a právních problémech, se kterými se ten který správce musel vypořádat. Dále kapitola popisuje znaky jednotlivých režimů kolektivně spravovaných práv. Na závěr se autor zmiňuje o právech a povinnostech správců vůči nositelům práv, uživatelům práv a státu. V dalších dvou kapitolách jsou rozebrány vlivy mezinárodního a evropského práva na národní právní úpravu. Rovněž je věnován prostor kritické analýze směrnice o KS, která si klade za cíl... Collective administration of copyright and neighbouring and relating rights Abstract This thesis relates to the collective administration, the reasons for its existence and development to this day. The purpose of my thesis is to describe rights and responsibilities of collecting societies in respect to other relevant legal persons and to evaluate their function with regards to the criticism among public about its abundance. Furthermore, the thesis analyses the influence of the International law and European law on the aspects of collecting societies in the legislation of the Czech Republic. The author also considers the rulings of both national courts, as well as The Court of Justice of the European Union. The thesis is divided into seven chapters. The first two chapters deal with the development of the collective administration in the world and in the Czech Republic. The third chapter is about the effective law regarding collective administration. The author discusses individual collective societies in the Czech Republic. Together with the description, thesis highlights legal issues respective society had to face. Next chapter features the individual regimes of collective administrated rights.
