Diplomová práce se zabývá kartelovými dohodami a programem Leniency, který je označován za efektivní nástroj k odhalování zakázaných horizontální dohod. Cílem práce je zhodnocení efektivity fungování programu Leniency v České republice. Na počátku se věnuji pojmu kartel z právního i ekonomického hlediska, formám a typům horizontálních dohod, tzv. hard-core kartelům, na které lze program Leniency aplikovat. Záměrem práce je legislativní, funkcionální a historická analýza programu Leniency od počátku až po současnost, přičemž jsem kladla důraz na změny, které vedly k větší efektivitě využívání tohoto vyšetřovacího nástroje a problémovým oblastem, které s programem souvisejí, např. kriminalizace kartelů, soukromoprávního vymáhání soutěžního práva a proceduře narovnání. V samotném závěru se věnuji efektivitě programu Leniency s uvedením statistických dat a především předložením nejvýznamnějším případům, ve kterých byl tento institut aplikován, což také dokládá jeho nezastupitelnou úlohu v odhalování horizontálních dohod ze strany Úřadu pro ochranu hospodářské soutěže. The final thesis deals with cartels and Leniency program, which is considered an effective tool for the detection of prohibited horizontal agreements. The aim of the thesis is to evaluate the effectiveness of Leniency program in the Czech Republic. At the beginning of the work I focus on cartel in legal and economic terms, then on forms and types of horizontal agreements, the so called hard-core cartels, which can apply the Leniency program. The intention of this work is legal, functional and historical analysis of Leniency program from the beginning to the present, emphasizing the changes that lead to greater efficiency in the use of this investigative tool and related problem areas eg. the criminalization of cartels, private enforcement of competition law and settlement procedure. In the end of the thesis I evaluate the Leniency program's effectiveness based on statistical data and especially the presentation of the most important cases in which this institute was applied, demonstrating its irreplaceable role in the detection of horizontal agreements by the Office for the Protection of Competition.
