Tato práce se věnuje posouzení možností umístění stavby na cizím pozemku. Cílem je nejen ukázat na jednotlivé tituly, které to umožňují, ale také jejich srovnání mezi sebou. Především je však tato práce zaměřena na institut práva stavby, který byl po několika desetiletích do našeho soukromého práva znovu zaveden s účinností od 1. 1. 2014. V první kapitole je pojednáno o právních možnostech umístění stavby na cizím pozemku z obecného hlediska. Zároveň se v této kapitole pojednává o základních pojmech, které s tématem stavby na cizím pozemku bezprostředně souvisí. Stěžejní část práce je věnována institutu práva stavby, jakožto možnosti umístění vlastní trvalé stavby na cizím pozemku. Nebyla opomenuta ani historie práva stavby na našem území a práce také obsahuje srovnání tohoto institutu s právem stavby v Rakousku. Právo stavby je v závěru stručně konfrontováno s dalšími možnostmi, jak umístit stavbu na cizím pozemku. Práce je členěna celkem do čtrnácti kapitol. Hlavní část práce, která je tvořena druhou až desátou kapitolou a která je věnována institutu právu stavby, obsahuje rozbor a hodnocení jednotlivých paragrafů právní úpravy v občanském zákoníku. Přestože je právní úprava práva stavby v řadě případů kusá nebo nejednoznačná, práce se snaží nabídnout pohled na možný správný způsob její aplikace.... This thesis explores options for placing building on another owner's land. It aims to identify the individual rights that enable it and provides a cross comparison of them. However, the key focus lies on the institute called right of building that was re- introduced into Czech private law as of January 1, 2014. The first section discusses legal options to locate a building on the land of another owner in general terms. It also defines key terms immediately related to the right of building. The core of the thesis focuses on the institute of the right of building as an option for construction building on the land of another owner. The historical development of the right of building in the Czech Republic and its historical predecessors is also discussed and compared with the institute of the right of building in Austria. In the final section, the right of building is compared to other options allowing for construction building on another owner's land. The thesis is divided into fourteen sections. The key portion, comprising Sections 2 through 10, discusses the institute of the right of building and contains an analysis and evaluation of the corresponding individual articles in the Civil Code.
