VADY ZÁJEZDU V ČESKÉM A EVROPSKÉM PRÁVU DEFECTS OF TOURS IN CZECH AND EUROPEAN LAW Mgr. Martin Šíp Praha 2016 ABSTRAKT Cílem této práce je popsat právní úpravu vad zájezdu upravenou v Občanském zákoníku z roku 2012. Na základě analýzy jednotlivých institutů vad zájezdu jsem dospěl ke koncepci vad zájezdu v českém právu a posoudil otázku, zda vady zájezdu připouští liberační důvody či nikoliv. Při řešení zvoleného problému jsem analyzoval možné inspirační zdroje pro výklad a dovození právní koncepce platné právní úpravy vad zájezdu, které představují interpretační vodítka pro výklad a pochopení vad zájezdu. Nejprve jsem analyzoval úpravu následků porušení smlouvy obsaženou ve Směrnici o souborných službách, která je vzorem pro vady zájezdu v českém právu a která upravuje liberační důvody z odpovědnosti pořadatele zájezdu za porušení smlouvy. V rámci českého právního řádu jsem zkoumal vztah mezi vadami zájezdu a náhradou škody způsobenou porušením smlouvy o zájezdu. Dále jsem posuzoval možnost použitelnosti obecné úpravy vadného plnění na vady zájezdu. V neposlední řadě jsem se snažil vymezit vady zájezdu ve vztahu k ostatním následkům porušení smlouvy. Historickou metodou výkladu jsem zkoumal možnost výkladu vad zájezdu prizmatem předchozí právní úpravy cestovní smlouvy. Srovnávací metodou jsem se snažil... DEFECTS OF TOURS IN CZECH AND EUROPEAN LAW Mgr. Martin Šíp Praha 2016 RESUME This thesis aims to describe the legal regulations applicable to defects of tours as enshrined in the Civil Code of 2012. Based on the analysis of various defects of tours, I have come to the concept of defects of tours in the Czech law and have assessed whether the defects of tours allows liberation reasons or not. When dealing with the issue chosen, I analysed the sources of inspiration for the interpretation and inference of legal concepts of the current legislation applicable to defects of tours, which present interpretive guidance for the interpretation and understanding of the defects of tours. First, I analysed the regulation of the consequences of a breach of contract as contained in the Package Tour Directive, which is a model for defects of tours in the Czech law and which regulates the reasons for liberation from the responsibility of a tour organiser for any breach of contract. Within the Czech legal order, I examined the relationship between the defects of tours and compensation for damage incurred as a result of any breach of a tour contract.
