Tato rigorózní práce se zaměřuje na problematiku postavení profesionálního sportovce z hlediska pracovního práva. První kapitoly jsou tematicky věnované vymezení závislé práce z hlediska Zákoníku práce a otázkám základních institutů pracovního práva, které jsou nezbytné pro srovnání postavení profesionálního sportovce. Dále je vymezen pojem sportovního klubu a profesionálního sportovce z hlediska českého práva. Na toto navazuje pojednání o právních vztazích sportovců a sportovních klubů a zároveň detailní rozbor profesionálních smluv uzavíraných mezi sportovci a sportovními kluby. Po analýze základních otázek právního vztahu mezi profesionálním sportovcem a sportovním klubem se tato práce zaměřuje na otázku srovnání pracovněprávní části s částí pojednávající o profesionálních sportovcích. Tedy hlavně na zodpovězení zásadní otázky, zda se dá výkon sportovní činnosti považovat za závislou práci dle Zákoníku práce. Ačkoliv se jedná o otázku zcela zásadní, český právní řád se k ní staví problematicky, kdy právní úprava zcela toto téma pomíjí. Oporu nenalezneme ani v případě české judikatury, která se do jednoznačného vymezení této problematiky nepouští. V závěru se práce věnuje úvahám de lege ferenda. This Thesis deals with the issue of a status of a professional sportsman in terms of labour law. First chapters are dedicated on the definition of dependent work in terms of the Labour Code and the questions of basic institutes of labour law, which are essential for proper comparing with the status of a professional sportsman. Further the key concepts of a professional sportsman and sport club are defined from the view of Czech Law. This Thesis continues with a treatise on legal relations between professional sportsman and sports clubs as well as detailed analysis of legal contracts between professional sportsman and sports clubs. After analysing the fundamental questions of the legal relationship between a professional sportsman and a sports club, this work focuses on the question of comparison of the labour section with the section dealing with professional sportsman. Primarily to answer a fundamental question, whether the performance of sports activities can be considered as a dependent work according to the Labour Code. Even though it is an essential question, it is problematic within the scope of Czech legal system, because there is no proper legislation. We don't even find support in the Czech case law, which doesn't contain clear definition of this issue. At the end of my thesis I deal with...
