Cílem této práce je analýza vztahu lidských práv a ochrany životního prostředí v souvislosti s právem člověka na životní prostředí určité kvality. Tato diplomová práce se člení na tři kapitoly. První kapitola se zaměřuje na teoretické základy problematiky, především na vztah oborů mezinárodní ochrany životního prostředí a lidských práv, na výhody a nevýhody jednotlivých přístupů k řešení a na definice nejdůležitějších pojmů vyskytujících se napříč celou prací včetně různého vnímání těchto pojmů jednotlivými autory. V druhé kapitole je rozebrána současná úprava těchto práv v mezinárodních dokumentech hard law i soft law na univerzální úrovni s přesahem do úpravy v rámci dokumentů regionální povahy. První část této kapitoly podává přehled dokumentů hmotněprávní povahy, které mohou obsahovat úpravu práva na příznivé životní prostředí, druhá část se zabývá dokumenty procesněprávní povahy se zvláštním zaměřením na Aarhuskou úmluvu. Třetí kapitola pak podrobněji rozebírá aktuální judikaturu Evropského soudu pro lidská práva v této oblasti a je rozdělena na tři části. První obsahuje exkurz do společných znaků rozhodnutí Soudu a na vývoj v rozhodování Soudu o ochraně environmentálních lidských práv, druhá část pak již konkrétně rozebírá nejdůležitější rozhodnutí týkající se relevantních hmotněprávních... The aim of this diploma thesis is the analysis of the connection between the protection of human rights to environment of the certain quality and the protection of the environment itself. The diploma thesis is divided into three chapters. The first chapter is focused on theoretical basis of the topic, especially the relation between two areas of law - international environmental law and human rights law, concerns advantages and disadvantages of the approaches to this topic, and definitions of the most important terms, including different use of these terms by the individual authors. The second chapter outlines the evolution of these rights in the hard law and soft law universal international agreements with the overlap into the regional systems of human rights protection. The first part of this chapter relates to the documents about substantive rights and the second part examines the procedural documents with special reference to the Aarhus Convention. The third chapter analyzes the case law of the European Court of Human Rights in detail; this chapter is divided into three parts.
