Diplomová práce pojednává o trestu domácího vězení, jeho právní úpravě v novém trestním zákoníku České republiky a jeho aplikační praxi v prvém roce účinnosti s přihlédnutím k novele této úpravy z druhého roku účinnosti, zároveň přináší porovnání s právní úpravou a praxí v SRN. Nejprve je pro lepší pochopení daného tématu představeno nové dělení trestných činů podle jejich závažnosti a systém trestních sankcí, který nový trestní zákoník přináší. Dále se práce zabývá problematikou domácího vězení jako nového alternativního trestu, zde je nastíněn účel alternativních trestů a pro zajímavost je uvedena také historická právní úprava trestu domácího vězení. Hlavní část této práce tvoří kapitoly, které se věnují právní úpravě trestu domácího vězení a jeho výkonu s ohledem na nedávnou novelizaci znění tohoto zákona. Následně se práce detailněji zabývá výkonem namátkové kontroly trestu domácího vězení pracovníky Probační a mediační služby ČR a jejími nedostatky při chybějícím elektronickém monitoringu. V další části je popsána právní úprava a aplikační praxe institutu domácího vězení v SRN v porovnání s naší právní úpravou. Aplikační praxe z České republiky tvoří další samostatnou kapitolu. Závěrečná část je věnována názorům odborné veřejnosti na trest domácího vězení v průběhu prvních dvou let. Cílem... This thesis deals with home arrest, its legal regulation in the new Criminal Code of the Czech Republic and its application practice in the first year of effectiveness, taking into account the amendment of this regulation in the second year of effectiveness and at the same time providing a comparison with the treatment and practice in Germany. For a better understanding of the topic, the thesis introduces at the beginning the new division of criminal offences according to their seriousness and the system of sanctions brought up by the new Criminal Code. The thesis then deals with home arrest as a new alternative punishment; the aim of alternative punishments is outlined and the historical regulations on the home arrest are stated there for the sake of interest. The main part of this thesis is represented by chapters dealing with legal regulations on home arrest and its execution, taking into account the recent amendment of this law. After that, the thesis deals in detail with controlling the home arrest execution by the Czech Probation and Mediation Service workers and with shortcomings of the controlling resulting from the missing electronic monitoring. In the following part, treatment and practice of home arrest in Germany is described as compared to the legal regulations in the Czech Republic....
