Poručenství Tato diplomová práce se zabývá institutem poručenství, nejdůležitějšími historickými milníky ve vývoji institutu poručenství a právní úpravou poručenství v České republice s přihlédnutím k právní úpravě poručenství ve Spolkové republice Německo. Poručenství je právním institutem, prostřednictvím něhož je zajišťována nezletilému nesvéprávnému dítěti, které se ocitlo bez potřebné právní ochrany, náhradní právní ochrana. Hlavním cílem poručenství je především zajištění náležité náhradní péče o právní záležitosti poručence. Diplomová práce je rozdělena do dvou hlavních částí a osmi kapitol. První část práce je věnována nejdůležitějším kodifikacím, které dle mého názoru nejvíce ovlivnily vývoj poručenství na našem území. První část práce pojednává o právní úpravě poručenství v právu římském, právu městském a zemském, ve Všeobecném občanském zákoníku a okrajově též o právní úpravě poručenství obsažené v zákoně o právu rodinném a zákoně o rodině. Druhá část práce se zabývá právní úpravou poručenství v České republice s přihlédnutím k právní úpravě poručenství ve Spolkové republice Německo. Druhá kapitola práce je věnována pojmu poručenství a pramenům právní úpravy poručenství v České republice. Těžiště práce je pak tvořeno třetí až osmou kapitolou, které pojednávají o vzniku poručenství, osobě... Tutorship (as type of guardianship). The thesis deals with a guardianship, with the most important historical milestones in a guardianship evolution and with the guardianship legislation in the Czech Republic taking into account guardianship legislation in the Federal Republic of Germany. Through the guardianship is provided alternative legal protection of legally incompetent minor lacking necessary legal protection. The aim of the guardianship is ensuring an appropriate alternative legal protection of ward's legal matters. The thesis is dividend into two parts and eight chapters. The first part is devoted to the most important codifications which in my opinion influenced the development of the guardianship on our territory the most. The first part deal with guardianship legislation in the Roman law, provincial and municipal law, in the General Civil Code and marginally about guardianship legislation contained in the Act of family law and in the Family Code. The second part of the thesis deal with guardianship legislation in the Czech Republic taking into account guardianship legislation in the Federal Republic of Germany.
