Cílem diplomové práce je rozbor právního stavu v otázce odpovědnosti za vady a záruky v občanském zákoníku a jejich sporných ustanovení. Práce zkoumá obecnou úpravu pro závazkové vztahy, zvláštní úpravy jednotlivých smluvních typů i specifika spotřebitelských vztahů, a to jak v zákoně č. 40/1964 Sb., tak v novém zákoně č. 89/2012 Sb. Práce se zabývá principy fungování odpovědnosti z vad a záruční odpovědnosti, práv z odpovědnosti za vady a postupu reklamačního řízení. Součástí práce je komparace české úpravy s úpravou anglickou. Z hlediska evropského práva je zkoumána správnost a vhodnost implementace směrnice 1999/44/ES do českého občanského zákoníku. The aim of this thesis is to analyse legal regulation of liability for defects and guarantee in Czech civil code and to elaborate problematic paragraphs of this area of law. Thesis defines general regulation, specific regulation for separate contracts and also specialities of consumer law according to civil codes no. 40/1964 and no. 89/2012. There are defined principles of liability for defects and guarantee liability, rights from liability for defects and complaint procedure. Thesis also contains comparision of Czech legal regulation with the English one. Law of European Union is added too, there is summarized the accuracy and suitability of implementation of European directive no. 1999/44/ES into the Czech Civil Code.
